Bosnia and Herzegovina hit rock bottom long ago. Despite having so many domestic, high-quality, reference-level, and internationally recognized legal experts, quasi-experts, often unheard of even in the countries they come from, are producing analyses of our judiciary.
They are sponsored by various centers, and the goal is one – to maintain a state of uncertainty and create fertile ground for new, unnecessary judicial reforms.
We all know, as do these “centers and quasi-experts,” that the main problem of the state of BiH is not the judiciary but the economy, unemployment, the departure of young people, an unstable political climate for serious investors, and a very favorable one for shady global swindlers...
However, politicians and individuals from the international community have managed to impose the narrative that the judiciary is to blame for everything. Is it?
Obviously, it is for certain individuals in politics and the international community, for which they, of course, have their reasons.
Yesterday's presentation of the analysis of war crimes case processing by the head of the OSCE Mission represents a new attempt to impose a “serious story” on the citizens of Bosnia and Herzegovina that our judiciary is very poor.
The presentation of this analysis can also be viewed from the aspect of maintaining an environment in which, through meaningless projects, individuals are enabled to portray the bad situation in BiH as even worse, which serves them to justify enormously high salaries.
No one claims there are no problems in the BiH judiciary. There certainly are.
We first need to establish the correct diagnosis, identify the problems, what is not good, and then, based on that, create a plan to improve the situation.
A certain, little-known judge, Joanna Korner, conducted an analysis that was supposed to identify areas hindering the implementation of the National Strategy for War Crimes Processing in Bosnia and Herzegovina. That is what the analysis's goal states.
However, what did she find? The author herself noted that there was not enough time to conduct a detailed analysis!?
So, it is superficial and, as the spokesperson of the BiH Prosecutor's Office, Boris Grubešić, said, “an analysis from the beach in Neum, without any scientific method.” And what then was the goal of presenting something that was not done in detail?
It is not difficult to conclude that neither Judge Korner nor her clients did this to help the Court and the Prosecutor's Office of BiH overcome the problems they face regarding war crimes prosecution.
For example, by providing them with additional funds, space, and a larger number of investigators so that they could finally, 21 years after the end of the war, finish the story about the criminals.
Where is the HJPC in this story? Where else but in the search for money for “new projects” that will enable them to travel outside Bosnia and Herzegovina, as one judge recently wrote in one of his columns.
It is incredible that an institution that should deal with the judiciary deals with everything else except what it was founded for. The HJPC has gladly left that job to various international organizations and self-proclaimed international experts, who, for example, have in their biography a “reference” that they have acquitted criminals who abuse minor children.
The members of the HJPC, who are obviously incompetent, are not interested in how the judiciary functions, whether judges and prosecutors do their job professionally or not, but are only interested in how to get another term and a good salary. Along with other privileges.
Because if they were truly dealing with their primary task, then Judge Korner would not be doing superficial analyses on the Neum beach. Why, for example, did they not include prominent BiH legal experts in the analysis, such as Professor Kasim Trnka, Ćazim Sadiković... or some of the judges of the Constitutional Court of BiH, for instance. They are also independent. And besides, they are highly reference-level.
Perhaps it would be better for the BiH judiciary if a thorough analysis of the work of the HJPC were done, because the fish always stinks from the head, not the tail.
How much money did the OSCE, or perhaps someone else, spend on this analysis, and who was it really intended for?
This kind of superficial, seaside analysis is not needed and serves no one, except those who purposefully commissioned it to initiate, for who knows how many times, the dismantling of the judicial institutions of Bosnia and Herzegovina.
One should not now think that the strategy of undermining the state Court and Prosecutor's Office will be stopped by this analysis, which did not achieve the desired results.
They will calm down for a while, and then a new blow will follow. Judging by the fierce response of the BiH Prosecutor's Office to the “criticism from the corner,” it will not be easy to turn back the clock to the dark age when certain high international officials issued orders to prosecutors and judges in BiH about which persons to prosecute.
