I think it is important today, when Municipal Councils are being constituted throughout BiH, to clarify the current legal and political situation in Stolac, especially from the aspect of the role of citizen Stjepan Bošković:
1. Citizen Stjepan Bošković is no longer the Mayor of Stolac Municipality, as he was not elected to that position, nor was he therefore issued any confirmation of election by the Central Election Commission of BiH on November 8.
2. Since it is clear that citizen Stjepan Bošković continues to present himself as the Mayor of Stolac Municipality even after November 8, 2016, he has thereby violated several laws and should be prosecuted for committing several criminal offenses, including the criminal offense of false representation under Article 369 of the Criminal Code of the Federation of BiH, usurpation of authority under Article 370 of the Criminal Code of the Federation of BiH, and unauthorized practice of a certain profession under Article 364 of the Criminal Code of the Federation of BiH.
3. Bearing in mind the above, and especially the fact that the commission of a criminal offense under Article 364 of the Criminal Code of the Federation of BiH precisely implies disrespect for the Central Election Commission of BiH as the body competent to issue a permit for holding the position of mayor, the Central Election Commission of BiH must immediately suspend candidate Stjepan Bošković and remove his name from the ballot paper when the local elections in Stolac are held (whenever that may be).
4. Bearing in mind the fact that there is no executive power in Stolac Municipality in accordance with the law, it is impossible to carry out any financial transactions in Stolac, including salary payments to budget users, as there is no authorized person to sign payment orders, nor is it possible to adopt the budget of Stolac Municipality for 2017.
There is no possibility of comparing the situation in Stolac with the situation in Mostar, where elections were not held based on the decision of the Constitutional Court of BiH, which is not the case in Stolac, and in Stolac, unlike Mostar, the Parliament of the Federation of BiH has not adopted any act defining the method of adopting and implementing the budget, nor is there a legal basis for it to be done.
