
In connection with the conclusion reached today by the VSTV, which states that the OSCE can have insight into war crimes cases handled by the Prosecutor's Office of BiH, a fierce polemic is underway, writes the Patria news agency.
In a statement to Patria, the Prosecutor's Office of BiH said that Bosnia and Herzegovina is an independent state that has laws and provisions that must be respected, and any different treatment constitutes a violation of the law.
- The reasons for the position of the Prosecutor's Office of BiH are that allowing insight into cases in the investigation phase would seriously jeopardize the confidentiality of investigations and violate the provisions of the Criminal Procedure Code and the Criminal Code of BiH, and this would constitute a criminal offense. Therefore, the collegium consisting of all prosecutors of the Prosecutor's Office of BiH took its position. With due respect to international legal experts, any insight into cases that are in the investigation phase, cases that are under indictment, information about witnesses, protected witnesses, etc., would seriously jeopardize the ongoing cases and the safety of prosecutors and parties in the proceedings - they say from the Prosecutor's Office of BiH.
They further add that nowhere in the world can foreign nationals gain insight into investigations and documents marked as confidential, and providing unauthorized persons with insight into documents marked as confidential constitutes a criminal offense, and this can only provide arguments for certain politicians that the judiciary is under inappropriate influence.
- Only the disciplinary prosecutor at the VSTV can have insight into the cases - they are clear from the Prosecutor's Office of BiH.
