Experts Demand Reaction from the FBiH Parliament: 252 Decisions Made Under Unconstitutional Decree!

An open letter was sent to Lidija Bradara by experts from the Association of Shareholders and Stakeholders (UDAU BiH), requesting her reaction as the Chairperson of the House of Peoples of the Parliament of the Federation of Bosnia and Herzegovina, reports the Patria news agency.

- Appreciating and recognizing your work, as well as your particular commitment to respecting the Constitution and decisions of the Constitutional Court of the Federation of BiH, we are again addressing you publicly to remind you that the Decision of the Constitutional Court of the Federation of Bosnia and Herzegovina, which declared the Government's Decree on the method of appointing leaders in public enterprises unconstitutional, was published in the Official Gazette of the Federation of BiH on March 16, 2016, almost two months after the Ruling – say the shareholders.

They further state that Bradara should be aware that the Government of the Federation of Bosnia and Herzegovina, under this unconstitutional Decree, dismissed and appointed numerous managements of public enterprises in the Federation, and that currently, at the helm of most public enterprises, the work of the management is unconstitutional, i.e., void.

- We hope that as the Chairperson of the House of Peoples of the Parliament of the Federation of BiH, you will demand from the Government of the Federation of BiH to urgently implement the recently published Decision of the Constitutional Court, which established that the 'Decree on the exercise of powers in companies with state capital under the jurisdiction of the Federation of BiH' is unconstitutional – they further state.

This Association had already warned in its previous open letters that the Government of the Federation of BiH, in which ministers from the HDZ BiH also participate, carried out a series (252 decisions) of unconstitutional, illegal appointments and dismissals in public companies based on this unconstitutional Decree.

- Through this, we publicly call on you, as the Chairperson of the House of Peoples of the Parliament of the Federation of BiH, to take appropriate actions within your competence to implement the Decision of the Constitutional Court and thereby ensure the legal order in the Federation.

We also believe that you are aware of the damage that the Federation of BiH suffers due to the non-implementation of Constitutional Court decisions and your obligation to take necessary actions to prevent it – state the experts from the Association.
