VELIKA KLADUŠA, (Patria) - The bankruptcy administrator of Agrokomerc, appointed to that position in September this year by the Municipal Court in Bihać, signed detrimental contracts for Agrokomerc between 2005 and 2009, the Federal Prosecutor's Office previously assessed in its reports.
Judge Aladin Bajrić of the Municipal Court in Bihać, in the pre-bankruptcy proceedings in the Agrokomerc case initiated at that court two months ago, appointed Šefik Smlatić as the bankruptcy administrator of that company.
From 2005 to 2009, Smlatić was the director of several companies belonging to the Lijanović family, which owed Agrokomerc and the state millions of KM over those four years. Therefore, Smlatić's appointment as Agrokomerc's bankruptcy administrator is now very risky for the company.
Some of the companies that did business with Agrokomerc to its detriment, and which Smlatić headed, include: „Lijanovići“, „Farmko“, „Laktal“, „Mesna industrija Farmer“.
In one of the contracts signed in 2007 between the company Mesna industrija Farmko and Agrokomerc, signed by Smlatić himself and the then director of AC, Mujo Milak, it states that Farmko will provide Agrokomerc with a loan of 50,000 KM, while Agrokomerc pledges property worth around 27 million KM to Farmko as collateral.
„Such a large difference between the loan and the collateral securing it can only indicate that the Lijanović family attempted to acquire valuable Agrokomerc property for a small sum, and Smlatić assisted them in this endeavor“, says one of Patria's sources from the company, showing the disputed contract.
The pre-bankruptcy proceedings in AC were initiated based on the claims of three legal entities from Velika Kladuša and three private individuals. The total claims with interest amount to only about 60,000 KM. Agrokomerc offered to settle the claims through an out-of-court settlement, but the claimants refused, raising suspicions that the pre-bankruptcy was a pre-arranged process for private individuals to acquire valuable Agrokomerc property.
The pre-bankruptcy proceedings themselves in this Velika Kladuša giant were initiated illegally, experts have previously claimed. At the time the pre-bankruptcy proceedings were initiated, Agrokomerc was still covered by the Law on Financial Consolidation of Business Companies of FBiH, making any talk of pre-bankruptcy in Agrokomerc a direct violation of that law.
„If Smlatić were to receive full authority as Agrokomerc's bankruptcy administrator, it would mean he would independently decide on the priorities for paying Agrokomerc's debts to claimants. He would also decide on the sale of Agrokomerc's real estate located both within and outside of Bosnia and Herzegovina, the value of which is estimated at hundreds of millions of KM“.
