The decision of the Constitutional Court of the Federation of Bosnia and Herzegovina, which declares the Government's Decree on the method of appointing heads of public companies unconstitutional, was published today in the Official Gazette of the Federation of Bosnia and Herzegovina, more than four months after the ruling, reports the Patria agency.
The Vice President of the Federation of Bosnia and Herzegovina, Milan Dunović, submitted a request to the Constitutional Court of the FBiH on June 9 last year to determine the constitutionality of the Government's Decree, which transferred the authority to appoint heads of public companies from the relevant ministries to the Government. The Democratic Front warned at the time that the FBiH Government was aligning a higher legal act, i.e., a law, with a lower legal act, which is illegal.
This decree of the Government of Fadil Novalić was the reason why the DF withdrew from the coalition with the SDA and HDZ BiH, and was replaced by the SBB.
It is indicative that the decision of the Constitutional Court was first awaited for five months, and then it took four months for the Decision to be published in the Official Gazette of the FBiH.
More than nine months have passed since the submission of the request for a constitutionality review. During this time, the SDA, HDZ BiH, and SBB continued to appoint their cadres to leading positions in public companies, reports NAP.
