Shameful acquittal for rapist: It's not rape because the victim was unconscious

A court in Oklahoma acquitted a 17-year-old accused of raping a 16-year-old, explaining that there was no coercion because the victim was under the influence of alcohol and unconscious, reports the Patria News Agency.

An indictment was filed against the unnamed teenager in 2014 on suspicion of assaulting a 16-year-old after a party, when he offered her a ride home. The girl was quite drunk, and according to witnesses, they had to carry her to the car. Another young man, who briefly joined them in the car, claims the girl was so drunk that she lost consciousness and only briefly woke up from that state.

The young man who offered her a ride left her at her grandmother's. As she had not regained consciousness even then, she was taken to the hospital. Staff conducted examinations to check if the girl had been sexually assaulted.

As a later test showed, the young man's DNA was found on her leg and around her mouth. The young man then claimed to investigators that the girl had consented to the act of oral sex, however, she said she remembered nothing from the moment she left the park. Prosecutors therefore initiated proceedings against the young man for forced oral sodomy, writes The Guardian.

The judge dismissed the case, explaining that their law cannot be applied to a victim who is incapacitated by the effects of alcohol.

"Forced sodomy cannot occur when the victim is so intoxicated that she is completely unconscious during the sexual act of oral copulation," the verdict states.

"I told the court that their argument was absurd, and they replied that they would not create crimes where they do not exist," the girl's lawyer told Oklahoma Watch, writes Index.
