KS Assembly on April 18 on the Law on Communal Police, Cantonal Administration for Communal Affairs to be established in KS

(Patria) - The draft Law on Communal Police of KS, which establishes the Cantonal Administration for Communal Affairs in KS, will be on the agenda of the continued session of the KS Assembly on April 18. 

Given the responsibilities, some employees will be transferred from the Cantonal Administration for Inspection Affairs. 

The Cantonal Administration of Communal Police will have communal police officers and communal inspectors, i.e., employees and civil servants.

Through the communal police and communal inspection, the Cantonal Administration exercises communal police and communal inspection supervision over the application of regulations within the scope of authority established by the Canton's regulations, which define the authority of the communal police and communal inspection.

A communal police officer assists a communal inspector in performing communal inspection supervision over the implementation of legal provisions.

Communal police officers perform communal police supervision over the implementation of the Law on Communal Cleanliness by taking over the competencies, obligations, and authorities of the Communal Order Service of Cantonal Public Utility Company "Park" Ltd. Sarajevo and Cantonal Public Utility Company "Rad" Ltd. Sarajevo, with additional and special authority to issue misdemeanor orders.

Communal police officers and communal inspectors are authorized by this law to perform communal police and communal inspection supervision related to the implementation of the Law on Obligations and Authorities of Controllers of Public Passenger Transport Operators in the Sarajevo Canton, actions related to the implementation of the Plan of Intervention Measures in Cases of Excessive Air Pollution in the Sarajevo Canton, the Decision on Protection and Improvement of Air Quality in the Sarajevo Canton in accordance with legal provisions relating to the protection of public interest and communal order in the Canton. 

Communal inspectors apply the provisions of the Law on Inspections of the Sarajevo Canton when performing communal inspection supervision.

The Government of the Sarajevo Canton, upon the proposal of the Ministry of Communal Economy, Infrastructure, Spatial Planning, Construction and Environmental Protection of the Sarajevo Canton, will appoint an acting head of the Cantonal Administration within 15 days of this law entering into force, for the period until the completion of the public competition procedure for the appointment of the Director.

With this law, the Communal Order Service of KJKP "Rad" Ltd. Sarajevo and the Communal Order Service of KJKP "Park" Ltd. Sarajevo will cease to operate six months after this law enters into force. After the cessation of operations of the communal order services, KJKP "Rad" Ltd. Sarajevo and KJKP "Park" Ltd. Sarajevo are obliged to assign their employees to other positions in accordance with their qualifications and other prescribed conditions.

The establishment of the Cantonal Administration for Communal Affairs aims to regulate the field of communal activities, ensure compliance with all legal provisions by natural and legal persons, and sanction non-compliance with legal norms.
