SDP, DF and GS: It is impossible to amend the Election Law of BiH before implementing the Strasbourg rulings

SDP BiH, Demokratska fronta and Građanski savez issued a joint press release, the content of which Patria transmits in full.

-The decision of the Constitutional Court of Bosnia and Herzegovina, upon the request of Božo Ljubić, is a consequence of the non-compliance of the BiH Constitution with the rulings of the European Court of Human Rights in Strasbourg in the cases Sejdić-Finci, Zornić and Pilav v. BiH. 

Now, presumably, it is clear to everyone why the implementation of these rulings has been refused for years, because that would finally abolish the principle of exclusivity of collective rights in favor of the civilizational principle of protecting individual rights of citizens, who must be equal in everything and everywhere, regardless of ethnic or any other affiliation.

The Constitutional Court of BiH is obliged to protect the existing Constitution of BiH, which contains a huge number of discriminatory provisions that should be nullified by implementing the aforementioned rulings of the Court in Strasbourg. With such a decision, instead of eliminating existing discriminations, new ones are being produced.

For this reason, we consider that the only correct and acceptable path for all citizens of BiH is the harmonization of the BiH Constitution with the elementary legal standards that apply in all European countries.

Any amendments to the Election Law of BiH are unacceptable before the BiH Constitution is harmonized with the rulings Sejdić-Finci, Zornić and Pilav v. BiH. This is a principle from which we will not deviate.

We demand from Bakir Izetbegović and SDA that, through their officials who have the right to do so, initiate a review procedure of the ruling made upon the request of Božo Ljubić, as soon as the necessary legal conditions are created for that. 

If Izetbegović does not do that, he will clearly and unequivocally place himself and his SDA on the side of those political forces that want to divide BiH into three ethnic territories.

Our political parties will persist in the fight for a BiH founded on the principles of anti-fascism and ZAVNOBiH, which 75 years ago established the formula according to which BiH is a state of all its peoples and citizens, equal and free on every inch of our homeland.
