SDA: Ruling coalition has consciously and deliberately brought the judicial system to the brink of collapse

(Patria) - The irresponsible policy of the "Trojka" parties and the concessions they made to SNSD and HDZ in exchange for entering power, all under the guise of Bosnia and Herzegovina's European path, have brought the entire judicial system to the brink of collapse, the SDA announced today.

"The inability to appoint new judges and prosecutors, which calls into question the functioning of the judicial system, is a direct consequence of the catastrophic Law on the HJPC that the ruling coalition adopted, despite warnings from the opposition, the professional community, and international institutions.

The fact that the new Law on the HJPC provides for the establishment of a Department for the Implementation of Procedures based on Reports, which conducts checks of property and interests of judicial office holders and without whose consent it is not possible to appoint new judges and prosecutors, and that the financial resources necessary for the functioning of that Department have not yet been secured, indicates the existence of a clear intention by representatives of the ruling coalition to stop the appointment of judges and prosecutors in this way.

This seriously undermines the entire judicial system in Bosnia and Herzegovina.

The continuous urgencies and letters from judicial institutions warning of such an outcome, which the ruling coalition ignored, further confirm the intention to limit the judiciary's capacity to prosecute and sanction attacks on the constitutional and legal order, organized crime, corruption, and other criminal offenses with which high-ranking government officials or persons close to them are associated.

The earlier excuses of the "Trojka" parties that the adoption of such a legal solution was an obligation on Bosnia and Herzegovina's path to membership in the European Union have been rendered meaningless by the content of the Law itself, which states that 'within one year from the date of entry into force, the Parliamentary Assembly of BiH will adopt the Law on the HJPC that will be aligned with European Union standards'," the statement from the Party of Democratic Action added.
