SDA CALLS ON PROSECUTOR'S OFFICE, OHR, PIC... You are obliged to stop militaristic provocations from RS

SARAJEVO, (Patria) - On the occasion of the marking of the unconstitutional day of the Republika Srpska entity, the Party of Democratic Action announced itself and called on all those obliged to protect Dayton, the Constitution and the constitutional-legal order of Bosnia and Herzegovina.

SDA demands that the Peace Implementation Council (PIC), the Office of the High Representative (OHR), and EUFOR finally start using their mandates to their full capacity and fulfill the obligations established by the Dayton Peace Agreement, and accordingly, without any calculation or delay, sanction all those who, by organizing the celebration of the unconstitutional day of RS and militaristic parades, wish to provoke incidents and disrupt stability in Bosnia and Herzegovina.

"The Constitutional Court of Bosnia and Herzegovina ruled that January 9 cannot be the 'day of RS'. With strong reasons for such a decision. On that day in 1992, a blow was struck against the constitutional-legal order of Bosnia and Herzegovina, an introductory act to aggression, ethnic cleansing, mass crimes, and genocide. In addition, January 9 and the reasons why the authorities of the RS entity decided to mark it as the 'day of RS' is discriminatory in its essence and in the way it is celebrated. The RS entity is not, nor can it be, an entity of only one nation.

Despite the ruling, which is final and binding, the authorities of the RS entity continue to mark this day, directly violating the decisions of the Constitutional Court of Bosnia and Herzegovina, and in addition, organizing parades with long guns and armored vehicles, thereby intentionally causing additional tensions. This is unquestionable and flagrant anti-Dayton action.

SDA demands that the PIC, OHR, and EUFOR finally start using their mandates to their full capacity and fulfill the obligations established by the Dayton Peace Agreement. In accordance with that mandate, they are obliged, without any calculation or delay, to sanction all those who, by organizing the celebration of the unconstitutional 'RS day' and militaristic parades, wish to provoke incidents and disrupt stability in Bosnia and Herzegovina," the SDA announced.

They also requested that the Prosecutor's Office of Bosnia and Herzegovina "stop calculating and finally initiate criminal proceedings against persons responsible for violating the decisions of the Constitutional Court of Bosnia and Herzegovina".

"This is a criminal offense punishable by Article 239 of the Criminal Code of Bosnia and Herzegovina, which states: 'An official in the institutions of Bosnia and Herzegovina, the institutions of the entity, or the institutions of the Brčko District of Bosnia and Herzegovina, who refuses to implement a final and enforceable decision of the Constitutional Court of Bosnia and Herzegovina, the Court of Bosnia and Herzegovina, the Human Rights Chamber, or the European Court of Human Rights, or prevents such a decision from being implemented, or otherwise obstructs its implementation, shall be punished with imprisonment from six months to five years,'" the SDA stated.

They call on the citizens of Bosnia and Herzegovina not to fall for provocations, "because the goal of those who violate constitutional and legal provisions in this way and organize parades is to cause incidents and endanger peace and stability."

"What the entire public can and should do is demand decisive action from those who are obliged to do so by the Dayton Peace Agreement and the Criminal Code of Bosnia and Herzegovina, so that after years of cowardly calculation, they finally start doing their job," the SDA statement added.
