Schmidt's reaction would shorten court 'torture', Emrić also expects a reaction

(Patria) - The RS Law on Immovable Property is awaiting adoption by the Council of Peoples to come into force, and along with that, the reaction of High Representative Christian Schmidt is also awaited.

He can react immediately after the Council of Peoples confirms the law and suspend it. Other announced assessments of the constitutionality of this law would have to wait for the publication of the Law in the official gazette to file a request. This would lead us into a new court dispute. Schmidt's action would shorten the time of 'torture'.

The adoption of the Law on Immovable Property for the purposes of exercising authority in the National Assembly of the Bosnian-Herzegovinian entity Republika Srpska (RS) is another violation of the Constitution of Bosnia and Herzegovina and previous decisions of the Constitutional Court of BiH and decisions of the High Representative when it comes to state property.

This was commented on today by Jasmin Emrić, a representative of NES in the House of Representatives of the PSBiH.

"I consider the act of adopting the unconstitutional Law on Property of Republika Srpska, adopted by the National Assembly of Republika Srpska, as another attempt to attack the sovereignty and territorial integrity of Bosnia and Herzegovina, because it indirectly seeks to take away its property from our state, which is the most important means for the exercise of public authority.

Therefore, I call on the High Representative in Bosnia and Herzegovina to use his powers to protect the state property of Bosnia and Herzegovina, as well as to sanction the perpetrators of activities and actions contrary to the previous decisions of the Constitutional Court of Bosnia and Herzegovina," Emrić stated.

He reminded that the issue of state property is exclusively within the jurisdiction of the state of Bosnia and Herzegovina, and not its entities as administrative units, on which the Constitutional Court of Bosnia and Herzegovina has ruled multiple times, and each time clearly established that Republika Srpska does not have the constitutional jurisdiction to regulate state property, because, in accordance with Article I/1, Article III/3.b, and Article IV/4.e of the Constitution of Bosnia and Herzegovina, it is the jurisdiction of Bosnia and Herzegovina.

"It is like that and it cannot be otherwise! The state of Bosnia and Herzegovina has always existed and will always exist! Whoever dislikes it, goodbye and have a nice day," Emrić said.
