Ifet Feraget's Reaction: Court Did Not Order New Expert Examination in Dženan Memić Case

SARAJEVO, (Patria) - Lawyer for the family of the murdered young man Dženan Memić, Ifet Feraget, issued his reaction to the media after the KS Prosecutor's Office sent a press release today regarding the Memić case, which was actually a submission by prosecutor Sead Kreštalica that was read out in court today and rejected by the court.

"After the acting prosecutor Sead Kreštalica, at today's continuation of the main hearing before the Cantonal Court in Sarajevo, which is being conducted against the accused Ljuba and Bekrija Seferović, submitted to the court the report of the traffic expert Ištvan Bodolo from Novi Sad, and proposed that the court review this report and summon this expert to clarify his alleged involvement in the preparation of the report and opinion of the Center for Expert Examinations 'Zenit' Banja Luka, the judge of the Cantonal Court in Sarajevo, Igor Todorović, was more than clear when he clearly told prosecutor Kreštalica: 'Prosecutor, this report from the Institute for Forensics and Design of doc. doctor Ištvan Bodolo does not have the expert's signature, it only has a number, I don't know what that means, it has no date, it only states 'in Novi Sad 2019', and 2019 is not a date. Furthermore, if it states 'Institute for Forensics and Design', it should also state the seal of that Institute on the report, and there is no seal. The report states 'acting on the order of Igor Todorović, Deputy Chief Public Prosecutor', but it does not state where.

You know very well that this court issued an order for expert examination to the Center for Expert Examinations and Appraisals 'Zenit' Banja Luka, that this Center submitted a report and opinion to the court, and I don't know what you want to prove with this report,'"

After that, the judge of the Cantonal Court in Sarajevo, Igor Todorović, was again more than clear when he told prosecutor Kreštalica the following:

"Okay, I repeat, I know whom the court gave the order to, to the team of experts. The team of experts consists of Dragan Salić, Aleksandar Jefić, and Slaviša Stojinić, and it was supplemented by Dr. Vlado Marković. Whether this report was prepared by Bodolo Ištvan, that is for you, prosecutor, you say you have initiated an investigation, prove it during the investigation, establish it, the court will not deal with that, so your submission is irrelevant to the court. For the next main hearing, the hearing of the team of experts from the Center for Expert Examinations 'Zenit' Banja Luka is planned, so prepare for the examination of the experts and possibly the presentation of closing arguments."

Therefore, from all of the above, it is more than clear that the Cantonal Court in Sarajevo did not order a new expert examination in the Dženan Memić case.

It is important to emphasize that the report of the Center for Expert Examinations 'Zenit' Banja Luka, which was presented to the court on 15.11.2019, already established that the traffic accident did not happen, just as it was previously established by the report of prof. dr. Mirsad Kulović. I would like to note that on 05.10.2018, the father of the murdered Dženan Memić, Mr. Muriz Memić, filed a criminal complaint with the BiH Prosecutor's Office against prosecutor Sead Kreštalica, as well as against eight other prosecutors from the Cantonal Prosecutor's Office of Sarajevo Canton who worked on this case, led by the then Chief Cantonal Prosecutor Dalida Burzić, and a large number of police officers from the Ministry of Internal Affairs of Sarajevo Canton, court experts, etc., and that the Prosecutor's Office of BiH has already opened an investigation against certain individuals. This prosecutor's office should verify all allegations related to the 'alleged expert report from Novi Sad'.

The aforementioned statement is given for the complete and accurate information of the public, given that information is being disseminated that could have a detrimental impact on the course and outcome of this court proceeding, stated Ifet Feraget in his reaction.
