Jobs at Elektroprivreda BiH were sold on SDA's orders

The noose is tightening around SDA officials Asim Sarajlić, Amir Zukić, and Mirsad Kukić. Namely, in the latest decision of the Municipal Court in Sarajevo, related to imposing prohibitive measures on Esed Džananović and others arrested in the "Bosna" operation, it is stated that the suspected executive director of Elektroprivreda BiH carried out illegal hirings exclusively on orders from his party, writes Zurnal.info, reports Patria.

"The benefit that the Council finds the suspect Džananović accepted in exchange for the relevant mediation (hirings) is the retention of his function, i.e., his position at work and in the political party of which he is a member," reads the decision of the Municipal Court in Sarajevo, made on December 16 this year.

The court council bases its conclusion on the testimony of witnesses and the statement of the suspect Džananović, given on August 27 this year in the presence of his lawyer Ifet Feraget.

The suspect Džananović, as stated in the decision, stated in his testimony that he was appointed to the position of executive director for distribution at Elektroprivreda BiH "as a qualified party cadre," and that he carried out instructions for illegal hirings on the orders of high-ranking party officials.

"When he accepted this position, he knew he had to act according to the party's instructions," the court document states.

HIRING OF OMER'S SON

The case of Amel Škaljo is one of the numerous pieces of evidence on the basis of which the Municipal Court concluded that Esed Džananović acted on orders from SDA. This concerns the hiring of the son of Omer Škaljo, an SDA representative in the FBiH Parliament.

According to intercepted phone conversations recorded by the Federal Police Administration, the general secretary of SDA, Amir Zukić, and the party's vice-president, Mirsad Kukić, urged his hiring at Elektroprivreda BiH.

First, according to information from the investigation, Amir Zukić called Esed Džananović, who then handed the phone to "Dr. Mirsad Kukić so he could also say something." Dr. Kukić then told Džananović that he had to hire the son of Omer Škaljo.

After that, Džananović took action and ordered Jasmin Karabegović, director of Elektrodistribucija Bihać, to hire Škaljo's son. However, Karabegović refused and was soon dismissed from his position as director of Elektrodistribucija Bihać. The son of the SDA federal representative then got a job at Elektrodistribucija Tuzla.

This particular hiring, completed without any public advertisement, is one of the controversial ones for which SDA leaders are suspected. Džananović was brought to this position by the SDA Personnel Commission, chaired by Vice-President Asim Sarajlić.

Specifically, the part of Džananović's testimony that the Municipal Court in Sarajevo also refers to, concerning "his dismissal if he did not follow instructions from SDA," incriminates Asim Sarajlić.

Article 382, paragraph two of the Criminal Code of FBiH states that anyone "who, using their official or influential position in institutions in the Federation, mediates the performance of an official act that should not be performed or the non-performance of an official act that should be performed, shall be punished with imprisonment from six months to five years.".

Three high-ranking SDA officials (Sarajlić, Zukić, and Kukić) are suspected of violating precisely these legal provisions. Due to this investigation, SDA leaders are avoiding dismissing Esed Džananović, who has been banned by the Court from holding any position in Elektroprivreda BiH until the criminal proceedings are concluded, despite the ongoing investigation. Namely, according to the Law on Ministerial, Governmental, and Other Appointments, as well as the Labor Law, Esed Džananović should have been dismissed three months after his arrest. However, although the fourth month is ending, Džananović has not yet been dismissed.

While he was in custody, Nevad Ikanović was appointed acting executive director for distribution, but his acting mandate has also expired. According to Žurnal's information, the relevant minister, Nermin Džindić, recently asked the SDA Personnel Commission to officially and in writing provide him with a proposal for the appointment of a new SDA executive director. The president of the SDA Personnel Commission, Asim Sarajlić, is avoiding doing so. Therefore, the position of executive director for distribution remains vacant until further notice.

In the meantime, the Municipal Court in Sarajevo has issued an order to check all bank accounts or safe deposit boxes that Asim Sarajlić, Mirsad Kukić, and Amir Zukić may be using.
