Weapons found in search of Stari Grad municipality belong to Club Point, had MUP KS permit for acquisition

(Patria) - Lawyer Alen Nakić, as representative of the Club for Practical Shooting & Tactical Training „Point“ Sarajevo, sent a public statement regarding the search of the premises of the Municipality of Stari Grad and the discovery of firearms in the premises of the Municipality of Stari Grad Sarajevo.

This club informs the public that the information that the subject weapons, which de jure in accordance with positive legal regulations have the character of sports weapons, were found in the premises used by the Municipality of Stari Grad, is absolutely untrue.

"Namely, the subject weapons, which represent sports equipment owned by the Club for Practical Shooting & Tactical Training „Point“ Sarajevo, Maršala Tita Street no. 50, 71000 Sarajevo, were absolutely not found in the premises that are in the possession of the Municipality of Stari Grad Sarajevo, but in the premises of the Club, which has possession of them based on a valid legal basis, i.e., based on the Lease Agreement concluded between the Municipality and the Club.

On the other hand, we particularly emphasize that the published information that the subject weapons were purchased or acquired by the Municipality of Stari Grad is absolutely untrue, which is clearly evidenced by the fact that the acquisition and payment of these were carried out by the Club with its own funds, in accordance with the acquisition decision issued by the competent authority of the Ministry of Internal Affairs of Sarajevo Canton, Police Administration Centar Sarajevo, by cashless payment from the Club's transaction account to the supplier's transaction account in accordance with the issued invoice/bill from the supplier.

In the context of the foregoing, we particularly emphasize that the subject sports weapons were kept in the Club's premises, where they were kept and stored, in accordance with the decision on keeping weapons dated 24.06.2022, while we particularly emphasize that the inspection conducted by the competent authority, i.e., the Ministry of Internal Affairs of Sarajevo Canton, Police Administration Centar Sarajevo, as evidenced by the Inspection Report, number: 02/9-03-1-269/23-I dated 27.06.2023, irrefutably established that the subject sports weapons are kept and stored by the club entirely in accordance with the provisions of the Law on Acquisition, Possession, and Carrying of Weapons and Ammunition ("Official Gazette of Sarajevo Canton", no. 1/2018, 13/2018 - corr. and 30/2019).

Consequently, given the described situation, and since these are irrefutably sports weapons owned by the Club, which were acquired and are kept in accordance with the decisions issued by the competent authority of the Ministry of Internal Affairs of Sarajevo Canton, Police Administration Centar Sarajevo, and whose safekeeping and possession are controlled through inspection by the competent authority, the sensationalism created in the public, even through official statements of the Federal Police Administration, regarding the fact that the subject sports weapons were kept in the Club's premises, appears absolutely unnecessary and completely malicious. This is all the more true because the competent authorities of the Ministry of Internal Affairs of Sarajevo Canton, Police Administration Centar Sarajevo, were absolutely aware that the subject sports weapons had been acquired, and that they were kept and stored in the official premises of the Club where they were found.

In the sense of the foregoing, we particularly note that by confiscating the subject weapons, even if it is a temporary confiscation of the subject sports weapons, the Club and its members are prevented from carrying out their regular activities, including conducting training and participating in both domestic and international practical shooting competitions for which purpose the subject sports weapons were acquired.

Furthermore, we particularly emphasize that the described procedure, for which there was absolutely no reason in the given circumstances, and the sensationalist approach to the fact of finding sports weapons in a place where the competent authority knew they were located, has caused immeasurable damage to the reputation of the Club and its members, both domestically and internationally. This is all the more true because the public statements mentioned above have created an unfounded conclusion that these are illegal weapons, although it is irrefutable that these are sports weapons that were acquired, kept, and used exclusively by the Club and its members in accordance with positive legal regulations.

This is all the more true because the Club, from its founding to the present day, insists on and cherishes the fundamental principles of the rule of law, and in every way condemns any illegal acquisition, possession, and use of firearms. On the contrary, one of the purposes and program goals, as well as the sports activity in which it participates, is completely lawful conduct in the acquisition, possession, carrying, and safe use of firearms.

Certainly, in the future, the Club will undertake activities in order to eliminate the unlawful encroachment on the Club's right to peaceful enjoyment of property under Article 1 of Protocol I to the European Convention on Human Rights and Fundamental Freedoms," stated the law office of Alen Nakić.

The Municipality of Stari Grad also issued a statement, stating that the weapons were found in premises rented by the Municipality, and that the weapons were not acquired for the needs of the municipality.
