Indictment Confirmed Against Seven Responsible Persons at RMU Banovići

(Patria) - The Municipal Court in Tuzla has confirmed the indictment of the Tuzla Canton Prosecutor's Office against seven responsible persons from the Brown Coal Mine (RMU) Banovići.

The indictment was confirmed due to reasonable suspicion that, while performing their managerial functions in the period from May 2020 to March 2021, they committed the extended criminal offense of abuse of position and authority as co-perpetrators.

The Tuzla Canton Prosecutor's Office announced that the indictment was confirmed against Fadil Kudumović (54), Jasmina Husić-Mujić (38), Selmir Bijelić (47), Ibrahim Demirović (50), Damir Mrkonjić (47), Emir Rahmanović (44), and Ekrem Demirović (50).

There is reasonable suspicion that during the mentioned period, Fadil Kudumović, as acting director of RMU Banovići, Husić-Mujić, Bijelić, Demirović, and Mrkonjić as executive directors for various sectors in the mine, used their official authority, aware that they were seriously violating the rights of other workers, and Rahmanović and Ekrem Demirović, as heads of organizational units, exceeded the limits of their authority, and as co-perpetrators acted contrary to the provisions of the Labor Law of the Federation of Bosnia and Herzegovina and the Statute of RMU Banovići.

Thus, knowing that both by law and statute discrimination against workers is prohibited based on membership or non-membership in trade unions and in relation to termination of employment contracts, and that a worker cannot be placed in a less favorable position due to trade union membership, and aware that 19 workers are or were members of the Trade Union Organization of RMU Banovići, and are not members of the Trade Union of Employees of RMU Banovići, solely for that reason, they made and signed decisions to terminate the employment contracts of these 19 employees, and offered them new employment contracts where they would perform jobs with lower coefficients for salary calculation, which the injured parties had to accept to avoid losing their jobs.

Therefore, as co-perpetrators, they caused them damage and seriously violated their labor rights.

Fadil Kudumović is covered by actions in all 19 counts of the indictment, while other co-perpetrators are covered in several counts each.

In this case, regarding two reported persons, an order not to conduct an investigation was issued because there are no grounds for suspicion that they committed criminal offenses, while for two reported persons, a prosecutorial decision has not yet been made, the Tuzla Canton Prosecutor's Office announced.
