Special Session of the RS National Assembly on Revision of the BiH Judgment against Serbia

The National Assembly of Republika Srpska will hold its 22nd special session today at 1:00 PM, with a single item on the agenda: Information on the request for revision of the International Court of Justice judgment in the case of Bosnia and Herzegovina against Serbia and Montenegro, Patria reports.

The Information states that according to the BiH Constitution, Article V.2, the BiH Presidency makes decisions by consensus, and in the absence of consensus, a decision can be adopted when two members vote for such a decision, and that in this situation the provisions of the BiH Constitution were not respected, because the BiH Presidency never considered the issue of initiating a revision in the case of BiH against Serbia and Montenegro, nor did the members of this body decide on it in terms of adopting a decision.

- Bearing in mind all the above, we consider that neither the material nor formal conditions for submitting a request for revision have been met, and that before the ICJ there is no active legal standing for such a procedural action. Any eventual appearance of the legal representative of BiH before the ICJ without a corresponding decision of the BiH Presidency is not legally valid and represents an act of unconstitutional action and false representation of that person - the Information that will be the subject of the special session reads.

Deputies at the session are expected to be addressed by the Chairman of the BiH Presidency, Mladen Ivanić, and the President of Republika Srpska, Milorad Dodik.
