Indictment Filed for Tax Evasion, BiH Budget Damaged by 99,294 KM

SARAJEVO, (Patria) - A prosecutor in the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor's Office of BiH has filed an indictment against Branislav Galić, born in 1974 in Zenica, a citizen of Bosnia and Herzegovina and the Republic of Croatia, and the legal entity Branex d.o.o. Busovača, whose founder and director is Branislav Galić.

The indictment states that Branislav Galić, in his capacity as director and responsible person with unlimited authority within the registered activity of the legal entity Branex d.o.o. Busovača, in the period from October to December 2009, committed VAT evasion in the total amount of 99,294.32 KM, for which amount the BiH budget was damaged.

The accused Galić is charged with obtaining documentation of false content, i.e., in his official bookkeeping records, he presented and calculated false entries of goods and the corresponding false documentation from an alleged supplier, a VAT payer, without such a purchase actually having taken place, and based on that, he illegally and unjustifiably presented and realized a deduction of input tax, thereby causing direct damage to the BiH budget.

The legal entity Branex d.o.o. Busovača is charged with, as a legal entity, disposing of illegally obtained property benefits, which were realized in the name, on behalf and for the benefit of the legal entity by Branislav Galić.

The accused are charged with having committed, Branislav Galić the criminal offense of tax evasion under Article 210, paragraph 2 in conjunction with paragraph 1 and Article 54 of the Criminal Code of BiH, and the legal entity Branex d.o.o. Busovača the criminal offense of tax evasion under Article 210, paragraph 2 in conjunction with paragraph 1 and Articles 54 and 124 of the same Law.

The indictment has been forwarded to the Court of BiH.
