Indictment for tax evasion

(Patria) - Prosecutor of the Department III of the Prosecutor's Office of BiH has filed an indictment against Vincek Stanko, born in 1962 in Ptuj - R Slovenia, a citizen of R Slovenia, and Jošić Goran, born in 1967 in Ključ, a citizen of BiH.

The accused are charged that, Vincek Stanko as director and responsible person, and Jošić Goran as executive director of the company "Mushrooms Trade" d.o.o. Laktaši, during September and October 2015, through submitted tax returns of untrue content, and by falsely representing turnover and purchase of agricultural products which did not actually occur, achieved a reduction of tax liabilities and illegally obtained the right to deduct input tax in the total amount of 21,163.12 KM, by which amount the budget of BiH was damaged, and the accused Jošić Goran entered untrue data in the business documentation.

According to the indictment, the accused Vincek Stanko is additionally charged that during the first half of 2017, while working in the same capacity for the aforementioned company in Laktaši, by providing false data, he procured a used business facility without deducted input VAT, and after investing in the said business facility, he sold the business facility to a company from Srbac, reducing the amount of output VAT by 10,275.00 KM, thereby damaging the budget of BiH for the stated amount in the described manner.

The accused are charged with committing - Vincek Stanko the criminal offense of tax evasion or fraud from Article 210, paragraphs 2 and 1, in conjunction with Article 53 of the Criminal Code of BiH, and the accused Jošić Goran the criminal offense of tax evasion or fraud from Article 210, paragraph 2, in conjunction with Article 29 of the Criminal Code of BiH, and the criminal offense of falsifying or destroying business or commercial books or documents from Article 274 of the Criminal Code of RS, applying Article 53 of the Criminal Code of BiH.

The indictment has been forwarded to the Court of BiH for confirmation.
