Indictment against the management of the cooperative 'Dobro Polje' for tax evasion

SARAJEVO, (Patria) - The Prosecutor of the Prosecutor's Office of Bosnia and Herzegovina has filed an indictment against Brkić Milena, born in Serbia, residing in Pelagićevo, a citizen of BiH and Serbia, founder and director of the General Cooperative “DOBRO POLJE” with p.o. Pelagićevo, and Brkić Gavro, born in 1961 in Pelagićevo, a citizen of BiH, authorized representative of the General Cooperative “DOBRO POLJE” with p.o. Pelagićevo, registered in the Unified Register of Indirect Tax Payers in the Banja Luka Regional Center.

The accused are charged that, in their capacity as director and authorized person of the aforementioned company, they generated taxable turnover in the amount of BAM 219,705.00 on behalf of the legal entity "Dobro Polje", which they partially recorded in the company's accounting records, but on which they did not calculate the applicable value-added tax in the amount of BAM 37,349.96, nor did they declare it in the VAT returns for the monthly periods during 2013, submitted to the Indirect Taxation Authority (UIO) of BiH.

The accused are charged with causing damage to the budget of Bosnia and Herzegovina in the amount of BAM 37,349.96 in the aforementioned manner, and obtaining unlawful property gain in the same amount.

The legal entity “Dobro Polje”, a general cooperative with p.o. Pelagićevo, is charged with having disposed of the unlawfully obtained property gain in the amount of BAM 37,349.96, which was realized on behalf of, for the account of, and for the benefit of the legal entity by the accused Brkić Milena and Brkić Gavro.

The accused are charged with committing the criminal offense of tax evasion or fraud under Article 210, Paragraph 1 of the Criminal Code of BiH.

The indictment has been forwarded to the Court of BiH.
