New Decree on State-Owned Companies Would Leave Ownership Unclear

Reuf Bajrović, Minister of Energy, Mining and Industry of FBiH, stated today that after yesterday's statements, it is clear that people are not familiar with the facts and everything that was said yesterday does not stand today, commenting on the decree on public enterprises in which powers are exercised by the Government of FBiH and FBiH bodies, which is supposed to be annulled, writes the BiH news agency Patria.

- The basis used was completely wrong. Ministers have power according to the law on business companies and the registry, not according to the decree. The Government can annul the decree, but it cannot pass a decree contrary to the law – Bajrović said.

He also stated that the introduction of a new decree is problematic and that he does not think it will happen.

- If it happens, a legal vacuum will arise, and it will be unclear who becomes the owner. We have nothing against decisions made within the law – Bajrović said.

We remind you that this decree was adopted in May 2011 and it "regulates the exercise of powers based on the participation of state capital in business companies in which these powers are exercised by the Government of FBiH, directly or through federal administrative bodies or through federal administrative organizations."
