SARAJEVO, (Patria) – A team of forensic experts from the Zenit Center for Forensics and Assessment from Banja Luka has requested an additional deadline for traffic forensics in the retrial of Ljubi and Bekrija Seferović in the case of Dženan Memić's death. Therefore, the hearing scheduled for July 30 has been postponed to September 19, confirmed the Patria News Agency.
According to the verdict of the Supreme Court of the Federation of Bosnia and Herzegovina, which overturned the first-instance acquittal of the Seferovićs, a new traffic forensics was also ordered. The team of experts from Banja Luka requested to visit the scene in Velika aleja, where the alleged traffic accident occurred on the night of February 8, 2016, in which 21-year-old Dženan Memić and his girlfriend Alisa Mutap were injured. The team of experts also requested the presence of medical experts, the Patria News Agency has learned.
According to the traffic forensics conducted at the request of the Seferović defense in the first court proceedings against the Seferovićs, expert Mirsad Kulović determined that there were no parameters indicating that a traffic accident had occurred at all. Thus, the point of contact of the alleged vehicle impact with the pedestrian was not determined.
Expert Kulović stated before the Cantonal Court in Sarajevo that there is no correlation between the vehicle damage found and the pedestrian's injuries that would correspond to injuries sustained in a traffic accident of the type "vehicle-pedestrian collision." The pedestrian had no leg injuries, although in accidents where a car hits a pedestrian, legs are injured first, then the head, chest, etc.
The Cantonal Court dismissed the findings of expert Ševal Kovačević, who conducted the forensics for the KS Prosecutor's Office, stating that his claims were "peremptory, speculative, even inappropriate and unserious for an expert assessment." In his findings, Kovačević even stated that the pedestrians were walking in the middle of the road and that there was a distance of 20 cm between them, which Alisa Mutap denied, stating that they were walking along the right side of the road and their shoulders were touching. Kovačević stated that Memić was thrown eight meters after the impact, for which there is no evidence.
The Memić family has been claiming for more than three years that Dženan was murdered, and the State Prosecutor's Office is expected to open an investigation soon. Muriz Memić, the father of the deceased young man, filed criminal charges against more than 40 people, led by Dalida Burzić, then Chief Prosecutor of the KS Prosecutor's Office. On two occasions, Burzić confirmed to Memić that Dženan was murdered. Nine prosecutors worked on the Memić case, which is unprecedented in court practice for a traffic accident case.
Burzić was appointed a judge of the Court of Bosnia and Herzegovina in February 2019.
