Nikšić: Why did the Court of BiH rule that ammunition be seized from the Armed Forces in favor of a company from Zagreb?

(Patria) - Croatian company „Skaut“, based on a ruling by the Court of BiH, is extensively seizing ammunition and weapons from the Ministry of Defense of BiH.

Nikšić asks how it is possible that seizure was allowed instead of monetary payment, whether it is true that this results in the loss of highly scarce ammunition in the amount of 1.7 million rounds of 12.7 mm caliber for PAM…

„Whose idea was it to carry out the seizure of ammunition (combat supplies) from the Armed Forces of BiH? How is it possible to allow enforcement – seizure of MTS against the Ministry of Defense in a situation involving highly scarce ammunition? Why, if the obligation of the Ministry of Defense has already been established, is enforcement not carried out in money instead of MTS?

Is it true that this results in the loss of highly scarce ammunition, as it involves nearly two million rounds of 12.7 mm for PAM, and of course other MTS? What price did the Court estimate per piece for more than six million rounds of various calibers that are subject to seizure?

What market price can be achieved for the MTS that is subject to seizure, and is that the reason for seizing ammunition instead of paying in cash, will anyone be held accountable if a difference in price is shown between the estimated value and the actual current market price, thereby objectively enabling the enforcement creditor to make an extra profit?“, states the parliamentary question.

The question further states that during the time of war conflicts and Russia's aggression against Ukraine, it is completely clear how all serious countries strive to secure their logistical base, retain and increase the level of equipment and combat readiness to the highest possible level.

„Unfortunately, I have received information that, along with the already poor state of our Armed Forces, today we also have threatened logistical supply, i.e., probably the only such example in the world where seizure of MTS, specifically the already scarce 12.7 mm round for PAM, is being carried out from the Armed Forces.

So, it is about the fact that ,,Skaut“ (SCOUT) d.o.o. Zagreb requests from the Municipal Court in Sarajevo, upon the request of the Court of BiH, to schedule the seizure of MTS against the enforcement debtor, the Ministry of Defense of BiH“, it is stated.
