Nikšić calls for action from prosecutors: List of suspicious privatizations!

The Government of the Federation of BiH, at today's session in Sarajevo, compiled a list of suspicious privatizations and requested judicial bodies to prosecute criminal offenses committed during privatizations, reports the BiH news agency Patria (NAP). Prime Minister Nermin Nikšić's government openly called on the judiciary to prosecute criminal offenses, also naming companies for which they received information or knowledge of irregularities.

The Government, as announced, after considering the "Information on identified irregularities in the privatization process and the operations of business entities after the completion of the privatization process or the opening of bankruptcy proceedings," adopted three conclusions.

The first conclusion requested the competent prosecutor's offices in FBiH to, as soon as possible, provide a statement on all reports of committed criminal offenses and other information submitted to them by the Financial Police of FBiH, and other institutions of FBiH, concerning abuses in the privatization process and the operations of business entities before, during, and after the completion of that process.

- Based on a series of requests submitted to the Government of FBiH by trade unions, disenfranchised workers, and other representatives of civil society, as well as based on information from the Financial Police of FBiH and other institutions, the Government of FBiH, by its second conclusion, requests the competent prosecutor's offices in FBiH to make final prosecutorial decisions in these cases - it is stated.

According to the Government's conclusion, the following business entities are involved:

  • Energopetrol d.o.o. Mostar (Petrol Ljubuški)

  • Konfekcija "Borac" d.d. Travnik
  • Trgovina "Borac" d.d. Travnik
  • Borac Export-Import d.d. Travnik
  • Alhos d.d. Sarajevo in bankruptcy
  • Soda so Holding "Dita" d.d. Tuzla
  • Tuzlanska Banka
  • Fabrika duhana Sarajevo d.d. Sarajevo
  • Bosnalijek d.d. Sarajevo
  • Šipad Komerc d.d. Sarajevo
  • Hotel Holiday Inn Sarajevo HTP
  • Soko Mostar (all companies created from the former system)

As explained, the Government of FBiH, the Prime Minister of FBiH, and federal ministers have repeatedly, since the very beginning of the FBiH Government's work in this mandate, received requests from various trade union organizations, disenfranchised workers, and other formal and informal groups to engage investigative bodies to examine the privatization process and subsequent operations in companies after the completion of that process.

- Based on these requests, the Federal Government asked the Financial Police of FBiH to verify such allegations in a number of companies, which resulted in the submission of reports by the Financial Police of FBiH to the competent prosecutor's offices regarding committed criminal offenses by. At the same time, information available to the Government of FBiH and its institutions, which was deemed to be helpful in making final prosecutorial decisions on the potential initiation of investigative actions and the filing of indictments, was forwarded to the prosecutor's offices - it is stated.

Based on the report of the Federal Prosecutor's Office on the application of the Criminal Code in FBiH for the years 2011, 2012, and 2013, which was submitted at the request of the Government of FBiH, it is evident that in the Federation of BiH during that period, despite a number of reports of committed criminal offenses and other information submitted to the prosecutor's offices, not a single indictment was filed for abuses committed in the privatization process.

- The Government of FBiH has done this, without intending to influence the decision-making and work of judicial bodies, and considering the daily justified interest of various representatives of disenfranchised citizens, as well as institutions that suffer damage - it is stated in the announcement, NAP reports.
