Disrespect of Constitutional Court Decisions is a Criminal Offense: The Prosecutor's Office of BiH Joins the 'Referendum' Case

Failure to enforce decisions of the Constitutional Court of BiH is a criminal offense, as these decisions are final and binding for everyone without exception. The most current decision concerns the unconstitutionality of January 9 as the Day of RS.

The authorities of the smaller BiH entity not only failed to respect the decision of the highest judicial instance in the state of Bosnia and Herzegovina, but also decided to take a step further in disrespecting it.

The NSRS adopted a decision on a referendum, and on September 25, citizens will vote on the decision of the Constitutional Court of BiH.

The referendum ballot that will be before citizens on September 25 will contain the question: "Do you support that January 9 be celebrated and observed as the Day of Republika Srpska?" The offered answers are: Yes and No.

Given that the names of the persons who committed the criminal offense, i.e., those who failed to enforce the decision of the Constitutional Court of BiH despite being obliged to do so, and those who organized the referendum are known, the Patria news agency sent questions to the Prosecutor's Office of BiH, to which we received a brief response:

-The Prosecutor's Office of BiH cannot provide any comment on the aforementioned inquiry.

The questions we sent to the Prosecutor's Office of BiH:

-Will the Prosecutor's Office of BiH, in accordance with its jurisdiction, open an investigation in the case of the "referendum in RS," more precisely due to the disrespect of the decision of the Constitutional Court of BiH, given that the names of the persons who initiated and organized the referendum, i.e., the persons who made the decision to hold the referendum, are known?

-Has the Prosecutor's Office of BiH ever opened investigations due to the disrespect of decisions of constitutional courts in this country, which have been issued over the past ten years, and there are dozens of such cases? If not, why has no one been criminally prosecuted for this, given that it concerns the highest judicial instance in the country whose decisions are not respected by politicians?
