Mutap and Others: Closing Arguments of the BiH Prosecutor's Office on October 27

(Patria) - The defenses of Zijad Mutap, Alisa Ramić, Hasan Dupovac, Josip Barić, and Muamer Ožegović, at the trial for concealing evidence, submitted material evidence before the Court of Bosnia and Herzegovina. 

Nina Kisić, defense attorney for the accused Mutap and Ramić, submitted 11 pieces of material evidence into the court record. To convince the Trial Chamber that the accused Mutap did not adjust his testimony, the Defense submitted three records of the accused's examination – one from the State Investigation and Protection Agency (SIPA) and two from the State Prosecutor's Office.

Regarding the content of the statement itself, attorney Kisić submitted the record of the hearing of the accused Ramić from 2021.

Continuing with the submission of evidence, the Defense submitted a report on the implementation of special investigative measures from 2016, which were, among others, carried out against the clients of this Defense.

Attorney Kisić also submitted several pieces of evidence related to the expert examination of the Renault Clio vehicle – specifically the expert examination of mechanical traces and paint from the vehicle. A phone log of the phone used by Mutap was also submitted.

Regarding the health condition of the accused Ramić, Kisić submitted an expert report from April 29, 2016, prepared by a neurologist. As the last piece of evidence, this Defense submitted certain selected medical findings of Ramić – such as the original epilepsy diagnosis from 2009 and findings showing the existence of a certain cyst, brain damage, and loss of vision in one eye.

The Defense of the third accused, Dupovac, submitted 21 pieces of material evidence. Among the submitted evidence is the work schedule in the Uniformed Police Sector from February 8, regarding when and at what hours Dupovac worked.

Attorney Ermin Gačanović submitted a notification from the Ministry of Interior of Sarajevo Canton (MUP KS) from February 24, 2016, which, as Gačanović stated, shows Dupovac's transparency regarding all the details he learned.

An official note was also submitted showing that the inspection of the Renault Clio vehicle was carried out as a team effort. This Defense also submitted certificates, notes, and records of the temporary seizure of the vehicle. An excerpt from the logbook was submitted showing that at 10:30 PM – at the time the event was recorded – Dupovac was not on duty, said defense attorney Gačanović.

Among the submitted evidence are also the order, record, implementation report, and certificate of seizure of video recordings from the property owned by Šerif Konjević and from the residence of the Kuwaiti Embassy.

Zijad Mutap, his daughter Alisa Ramić, formerly Mutap, then-head of the Traffic Investigations Department Hasan Dupovac, police officer Josip Barić, and hotel worker Muamer Ožegović are being tried for concealing evidence.

Kadrija Kolić, attorney for the accused Barić, submitted an order for blood analysis from February 23, 2016, stating that one trace originated from Ramić. The Defense of the fourth accused also submitted an order for expert examination and the expert findings on the clothing of Ramić and Dženan Memić.

Kolić stated that he is submitting an official note made by Barić on February 9, 2016, which shows that Barić "acted as a highly conscientious and professional police officer." An act from the Federal Prosecutor's Office was also submitted, which, as Kolić said, supervised the investigation of the Cantonal Prosecutor's Office and found no omissions.

Ožegović's Defense submitted several pieces of evidence, including a recording from the "Crystal" hotel, stating that "the resolution and quality can be seen from the said recording." Attorney Edin Šećerbegović also submitted the results of Ožegović's polygraph test at the MUP KS and documentation regarding the accused's financial status, stating that Ožegović has no property and is in debt.

"He is certainly not a member of an organized criminal group," said Šećerbegović.

The continuation of the trial is scheduled for October 27, when the closing arguments of the Prosecutor's Office are planned, Detektor reports.
