Memić: The court will decide, but a dead man cannot fall and no one be held accountable

SARAJEVO, (Patria) – Muriz Memić said after today's closing arguments at the Court of Bosnia and Herzegovina in the case of Zijad Mutap and others, which is being conducted for concealing the manner of Dženan Memić's death and fabricating evidence, that "Alisa Mutap led Dženan to his death."

"She is responsible for that. As the prosecutors said, if everyone invoked amnesia, then no one would be guilty. The court will decide, just let them rule according to the law, but Alisa Mutap is responsible. Dženan had no enemies; he was brought there. We didn't call her out for nothing; it has been proven that there is no amnesia. This cannot end like this, that Dženan was killed and no one is held accountable. The greatest insult I experienced at the beginning of the trial was when Nina Kisić said that I should also be sitting with the accused. I promise them that they will be tried again, but for much more serious offenses," said Memić.

Speaking about the new investigation into the murder of Dženan Memić, the young man's father said that without an indictment for murder, it is impossible to find out who killed Dženan.

"We must find out who killed Dženan; Alisa is the one who was with him. Alisa, to whom she is accountable, we see she will never say. But the success is that we brought them to the courtroom. I am not happy that they will be in prison, and Dženan is gone, but they must be held accountable," said Memić.

Lawyer Ifet Feraget, who also delivered closing arguments today, said his first comment was: "In stone, nothing human; in humans, everything is stone."

"Some are bothered by quips, Latin sayings, but I am bothered when someone considers this state a tyranny. Quoting Njegoš, whom I read much earlier in high school than the defense counsel of the first and second accused, in the context of our socio-political moment, sounds very simple; it sounds like we live in a state that is a tyranny. The investigation was conducted by the Prosecutor's Office, filed by the Prosecutor's Office, confirmed by the Court; the state stands behind both the investigation and the indictment. The court makes its decision based on the evaluation of evidence. That principle is not unlimited; it is limited by the rules of logical reasoning," said the lawyer.

Feraget said that the overall behavior of Alisa Mutap shows that something is not right, but that the Court should judge that.

"This proceeding has begun to lay the foundations for a new indictment. Since the law recognizes deadlines, the Prosecutor's Office could not afford to investigate all of this. I filed a report against 49 individuals. Everything indicates that an adequate investigation was not conducted. This is a test for our judiciary.

The problem is not that someone does not remember, as the defense tries to interpret, but the problem is when someone does not want to remember. The context of this event and the overall behavior of both Alisa Mutap and the prosecutors and investigators is strange," said Feraget.
