Majkić objects to prison sentences for non-compliance with court rulings

At the session of the House of Representatives of the BiH Parliament, representatives are considering the Bill on the Constitutional Court of BiH and the Bill amending the Criminal Code of BiH in the first reading, with the opinion of the Constitutional-Legal Committee. These legislative proposals, submitted to the parliamentary procedure by SNSD and SDS representatives, did not receive support from the Constitutional-Legal Committee for compliance with the BiH Constitution and legal system, nor for the principles of the proposed laws, writes the BiH news agency Patria.

Dušanka Majkić (SNSD) said she was unpleasantly surprised by the committee's negative opinion.

- This is something that is difficult to understand if you know that the Criminal Code was imposed by the High Representative. We can talk about principles, but the essence of the law is the proposed deletion of the article stating that an official in BiH institutions who refuses to execute a court decision is sanctioned with a prison sentence. Few countries have such a legal solution. The highest number of unexecuted court decisions are by those who are now fighting for this – Majkić stated.

Zaim Backović, a BPS representative in the House of Representatives of the BiH Parliament, said that it is not true that BiH is unique in punishing non-compliance with court decisions with a prison sentence. The proponents did not want to combine these two agenda items.

Sadik Ahmetović (SDA) told Dušanka Majkić that not all representatives from RS think the way she said, as he comes from RS.

- You do not see others and thus pass laws, and then the Constitutional Court must intervene. To make matters worse, you say that other countries do not have this. Name any country where one part of the country does not respect the decisions of the Constitutional Court; if such a country exists, I will change my opinion – Ahmetović said.

Majkić said she wanted to say that there is no such form of sanctioning anywhere in the world.
