Controversial Law on Immovable Property Tax in RS to be Reviewed by Constitutional Court of BiH

The joint commission of the Council of Peoples of Republika Srpska and the National Assembly of this entity did not adopt the amendment by the Bosniak Caucus of the Council of Peoples of RS, which requested that an unpaid bill for immovable property tax in this entity cannot be an enforcement document, Mujo Hadžiomerović, delegate in the Council of Peoples of RS, confirmed this for the BiH news agency Patria.

The controversial Law on Amendments to the Law on Immovable Property Tax in Republika Srpska stipulates the payment of property tax, which, if not paid within eight days of the invoice date, allows the RS Tax Administration to seize the property from its actual owner, sell it at auction, and thus collect its claims.

The Bosniak Delegates' Caucus in the Council of Peoples of RS requested that an unpaid bill cannot be an enforcement document, meaning that the RS Tax Administration cannot mortgage and sell land without a court decision, but the authorities in RS did not comply with this.

Hadžiomerović confirmed for Patria that after the proposed amendment was not adopted, the Bosniak Delegates' Caucus in the Council of Peoples of RS will initiate the issue of the constitutionality of this law before the Constitutional Court of BiH.

- The eight-day period has now been extended to 15 days, but that is not what we wanted to achieve - said Hadžiomerović.

Hadžiomerović previously stated that the Law on Amendments to the Law on Immovable Property Tax in Republika Srpska is not naive at all, and has only one goal, which is to seize land from Bosniaks in this entity.

He said that a whole set of laws has been adopted in Republika Srpska recently, aimed at seizing property from Bosniaks in this entity, primarily the Law on Cadastre, and now the Law on Amendments to the Law on Immovable Property Tax, writes Patria.
