
(Patria) - The Supreme Court of the Kingdom of the Netherlands has upheld the 2017 Court of Appeal ruling that the Netherlands is partially responsible for the death of 350 Srebrenica victims killed in July 1995.
The killed Srebrenica victims for whom the Netherlands bears responsibility were expelled from the base of the Dutch UN battalion on July 13, 1995, after which they were executed. As the Supreme Court ruled, the Netherlands is liable for responsibility at a rate of 10 percent, in the context of assessing the probability that the captured men would have survived had the Dutch soldiers kept them in the base.
That rate was 30 percent in 2017.
More than 6,000 family members of those killed in the Srebrenica genocide sued the Netherlands in 2007, and seven years later the District Court in The Hague found that the Netherlands was responsible for the death of more than 300 men whom the Dutch battalion expelled from the UN base on July 13, 1995, knowing they would be killed.
However, the victims' families and the state of the Netherlands appealed this ruling. The Court of Appeal in 2017 confirmed the responsibility of the Netherlands.
Earlier, in 2013, the Supreme Court, in a lawsuit by Hasan Nuhanović, issued a decision under which the Netherlands is responsible for the death of three Bosniaks from Srebrenica.
