Regarding the decision of the Council for the Protection of Vital National Interest of the Constitutional Court of FBiH, which rejected the appeal of the Serb Club in the House of Peoples of FBiH, Predrag Kojović, a delegate in the House of Peoples of FBiH, has made a statement, reports the Patria News Agency.
“Any legal analogy with the court decision in question convincingly suggests that all decisions – from the election of the executive government to key laws and decisions adopted during this mandate – are unconstitutional and consequently invalid.
If the majority is not calculated based on the actual but the prescribed number of delegates, then 30 votes are needed for a qualified majority in the House of Peoples, not 28. It doesn't take much imagination to understand the consequences of this stance by the Court. Namely, it states that some of the most important acts of this House in this mandate were adopted without sufficient votes,” Kojović explained.
“The imperative to get out of this situation will require unprecedented constitutional and legal acrobatics, and in my assessment, a reaction from the OHR. My hope is that this case will finally force Parliament to move towards a comprehensive amendment of the FBiH Constitution.
Anything less than that will be a sign that there is no political will in the FBiH Parliament to build a functional, European constitutional and legal system, and that the reform agenda is just a popular phrase that the authorities use to apply for credit funds,” Kojović concluded.
