How Dragan Lukač, with the support of Minister Čampara, tried to deceive the FBiH Government

Written by: Jozo Anđić

In my previous text, I announced that Dragan Lukač, director of the FUP, would, in his own peculiar and perfidious way, circumvent the decisions of the FBiH Government, or the competent Federal Ministry of Finance, and find an illegal way to pay funds based on lawsuits we filed, for which court decisions have become final. I mentioned then the possibility that Lukač would pass an illegal regulation and use its provisions to secure payment in the first group, even though he is at the very end of the list according to the official order.

To clarify, the decision of the Federal Ministry of Finance, number: 07-14-4-8523-2/15 A.Ć. dated 03.03.2016, strictly stipulated that court decisions/enforcement orders (based on the aforementioned lawsuits) must be executed quarterly, that interest calculation must be done up to the last working day of the quarter, and that payments must be made in chronological order, i.e., by the date the judgments become final (from older to newer). This decision of the Federal Ministry of Finance was preceded by the Instruction on the method of realizing court decisions (judgments/enforcement orders) under number: 07-14-4-8523/15 dated 28.12.2015. That Instruction explicitly stated in point four: "When processing court decisions, budget users are obliged to consider the date of their issuance, i.e., to process and pay according to the age of the judgments, in order to save funds on interest." However, none of these documents prevented Dragan Lukač from, once again and for who knows what time, placing himself above all laws in FBiH, and creating the Rulebook on the method of determining ranking lists of employees of the Federal Police Administration for the payment of claims based on court decisions (judgments/enforcement orders) in 2016. The Rulebook was adopted under number 09-2634 dated 02.03.2015. In this illegal Rulebook, Dragan Lukač, through the formal work of a commission (which he formed to realize his illegal intention), chaired by Maida Čustović, prescribed criteria by which those with the highest police rank (which he has) would practically have absolute priority according to the criteria, thus directly securing priority for himself (because he has the highest rank), even though he is somewhere at the end of the official list!

However, fortunately, the Federal Ministry of Finance identified this illegality, and with its written act number: 07-14-4-2249/16 A-Ć. dated 31.03.2016 (signed by Minister Jelka Milićević), warned the Federal Minister of Internal Affairs Aljoša Čampara that the aforementioned Rulebook of the Federal Police Administration is illegal because it "enables a privileged status in the order of execution to certain categories of employees depending on rank, title, agreement on waiving interest, employment status, and status based on payment category." At the same time, they reminded Minister Čampara that according to the Law on Internal Affairs of FBiH, it is the Minister (i.e., Čampara) who manages the ministry, and that the director of the FUP is directly accountable to him for his (in)action, and they asked the minister to take all measures, actions, and procedures within his authority to resolve this illegal attempt (read: fraud) that the illegal director of the FUP tried to realize through deception of the Federal Ministry of Finance by submitting a Request for ensuring the legality of payment of claims based on court decisions, from the Trade Union of the Federal Ministry of Internal Affairs Sarajevo, number: SS-43/16 dated 29.03.2016.

Within this Rulebook, or rather, the creation of some kind of ranking list, Dragan Lukač committed another deception and illegality. Namely, among the criteria, waiving interest is also included (which carries a certain number of points). Since many employees were not even given the opportunity (nor were they asked) to express their opinion on this possibility, the question arises as to how it was possible to form any ranking list at all. Therefore, this is another Balkan fraud and inhumanity, orchestrated by Dragan Lukač. Accordingly, I remind Minister Čampara that he must finally start interfering in his job, because according to the strict provisions of the Law on Internal Affairs of FBiH, the adoption of rulebooks falls under the jurisdiction of the minister. This is already, who knows which rulebook in a row, that Lukač is adopting, practically without the minister's involvement (which I cannot believe at all), which clearly shows how much he does not respect and value him!

Is there greater despair in the rule of law than the situation where the Minister of Finance has to warn the Federal Minister of Internal Affairs in writing about how to act in accordance with the law? Because, if the Federal Police Administration is trying to commit such frauds, the question arises by what right does that same Administration interrogate the illegal work of other institutions and individuals within those institutions?!

If you thought that the illegalities of Dragan Lukač related to this list and Rulebook ended here, you were gravely mistaken. Namely, he personally removed Blaženka Čerkez and Dragan Vikić from the list compiled in this way. The explanations Lukač gave go beyond the level of normal communication, intellect, and human dignity, so I will not list them here.

Attempt to Discredit Me

The fact that Dragan Lukač is somewhat afraid of my writings is evidenced by the fact that on 17.03.2016, Zoran Čegar, head of the Uniformed Police Sector of the FUP, held a meeting with junior management staff on Lukač's strict orders and informed them that I, Jozo Anđić, am banned from entering the premises of my former organizational unit. However, immediately afterwards, Čegar called me and told me to come and sign the annual performance evaluation. During my arrival, entry, and stay in the premises of the Uniformed Police Sector, I experienced a series of unpleasant situations and humiliation. Of course, I tried to defend my dignity by not accepting unlimited humiliation. The servile Čegar immediately took advantage of this, and they even called police officers from the Novo Sarajevo Police Department, as well as officers from the Uniformed Sector Support Unit, to sort things out and conduct some kind of targeted investigation against me and the like.

Čegar initiated disciplinary proceedings against employee Alić Dragana, who was performing security duties for the police academy complex, because she refused to include false information in her report, namely, that I, Jozo Anđić, was violent and had entered the center of the Police Academy complex. On this occasion, I will state directly that police officer Dragana Alić is a much more and above all unconditionally honorable, just, and brave police officer, and that Zoran Čegar is not even worthy of her shoes, neither in conduct nor in fairness, let alone honor. For example, he has the most severe diagnosis of a mental condition, and it is a sad institution, and in this case, the FUP, which has such a person in its ranks.

Attempt at a New Deception – Victim: FBiH Government

These days, employees of the Police Academy of the FMUP, completely disappointed in the system and their minister Aljoša Čampara, are loudly expressing their dissatisfaction with a move by Dragan Lukač, which has set them back and brought them to a level of absolute despair. What is it about?

On 01.04.2016, the Government of the Federation of BiH had an information from the FMUP on its agenda, related to the implementation of Article 86 of the Law on Internal Affairs of FBiH, as well as a proposal for an appropriate decision related to that information. With that article of the law, the legislator provided for an increase in salary by up to 30% for a certain category of civil servants and employees of the FMUP and FUP, due to special working conditions and responsibilities. And nothing would be controversial if fair, normal, and legal criteria were followed during the formation of the list of job titles that would receive a salary increase. Namely, employees of the Police Academy would certainly belong to that group. However, in the same list, the illegally appointed director of the FUP, Dragan Lukač, included his secretary!? When the ministers in the FBiH Government saw this, they elegantly rejected the list and requested its revision based on realistic parameters in accordance with legal provisions, not according to the wishes of director Lukač. In this way, the mentioned list was challenged (until further notice), and the disappointed and angry employees of the Police Academy were left to wait, remain silent, and suffer, all due to the unreasonable desires of Dragan Lukač. Here, of course, Minister Čampara should be asked, who knew that the list of job positions he submitted to the FBiH Government was not conceived in accordance with real and normal arguments and legal factors, why did he submit such a list to the FBiH Government in the first place!? Why does Minister Čampara fulfill all the illegal wishes of the illegal director Dragan Lukač? What is the price of that? It remains to be seen whether Čampara will allow Lukač to exercise his arbitrariness in forming the new list, outside of any criteria and legal provisions. Until then, the degraded and humiliated employees of the Police Academy, led by Nusret Bečirević, are left with only the taste of deception in their mouths. Will they also rebel publicly?

On the other hand, to be a little humorous, perhaps there is a real basis for Lukač's secretary Behija Kršo to be on that list. Namely, those who know at least a little about the (in)human and professional qualities of Dragan Lukač certainly believe that after Lukač leaves (and that will happen one day), his secretary will suffer from PTSD-L (Post-traumatic stress disorder of Dragan Lukač)! That's why she needs a salary increase!
