Kajganić and the silent prosecutors of the Prosecutor's Office: When 'heroes of the month' arrive late to Kosovo!

In Bosnia and Herzegovina, war criminals do not flee by accident. They leave on time. Always informed, always one step ahead of the judiciary, always in the same direction – Serbia or Croatia, with the full or tacit support of the ruling structures, but also of the Prosecutor's Office itself. This is not a conspiracy theory, but a pattern that has been repeating for years without a single serious institutional response. Therefore, the High Judicial and Prosecutorial Council bears full responsibility.

Dozens of suspects for war crimes, after being "discreetly" informed that an indictment is being prepared against them, cross the border without any obstacles. Some are stopped at the last moment, like Mile Došenović on December 26, 2025, at the Popovi border crossing, but exclusively because the BiH Border Police reacted. Everything indicates that Došenović knew an indictment was being prepared.

Situations like these are not uncommon, and they repeat because a serious investigation file has never been opened at the BiH Prosecutor's Office, nor has anyone seriously dealt with it. The goal was one: to prosecute those who are available, which are mostly members of the Army of RBiH and the Ministry of Internal Affairs of RBiH.

The most devastating example of institutional collapse is the escape of Milomir Savčić, an indictee for genocide in Srebrenica. Year after year, since 2021, Savčić has been "unavailable," while judicial institutions act as if it is an unsolvable mystery. But it is not. Savčić did not disappear, he left. With logistics. With support. With the tacit approval of the system.

A man whose Bosnian and Serbian passports and identity card were revoked, who was banned from moving and leaving his residence, crossed the border. Not a metaphorical one, but a real, guarded state border. This required a wide network of helpers, from police to political structures. That network has never been broken, nor has anyone been prosecuted.

It is particularly scandalous that Savčić was remanded in custody due to the risk of influencing witnesses and evidence, not due to the risk of flight. And then he fled. As if the judiciary had signed its own confession, either of its incompetence or of its open complicity.

Despite everything, Milanko Kajganić was appointed, first as acting, and then as Chief State Prosecutor. That appointment should never have been possible until it was determined how Savčić escaped. Not politically, but professionally. Not symbolically, but substantively.

Because how can a man lead the Prosecutor's Office in whose mandate one of the most serious indictees for genocide simply vanished?

The responsibility does not lie solely with Kajganić. The High Judicial and Prosecutorial Council (HJPC) bears enormous responsibility, an institution that for years has shown that it can be strict only towards those who do not have political protection. The "silent ones" from the BiH Prosecutor's Office also bear responsibility, diligently guarding their positions while the system rots and justice becomes increasingly unattainable.

Inaction, negligence, and systemic failures of prosecutors are rarely sanctioned. Disciplinary proceedings are rare, mild, and without real consequences. Everything, in the end, comes down to political dominance.

Only when politics "gets involved" do institutions wake up. And not because of justice, but because of interests. Sanin Bogunić, who replaced the suitable Halil Lagumdžija at the head of the HJPC, a man crucial for Kajganić's appointment as head of the Prosecutor's Office, has not yet responded to the difficult task.

Meetings with victim associations and promises no longer work.

While Savčić walks freely in Serbia, even appearing on the public service and giving interviews as if he were the freest man in the world, members of the Army of RBiH have been dragged through courts for years, proving that they defended an internationally recognized and attacked state, Bosnia and Herzegovina. And on that test, everyone failed, from the 'heroes of the month' to every employee of the Prosecutor's Office.

Therefore, it is high time to clearly state that justice in BiH is not late, it is intentionally slowed down and selectively applied. Džermin Pašić, who today leads open conflicts with Kajganić, also knows this. But when "Marko arrives late to Kosovo," the battle is already lost, and the battle he embarked on with Kajganić is not in the name of justice, but of his own interest. As the people say, it's a case of one bad situation leading to another. In the end, he too knows how he got the title of 'hero of the month' on the wings of Michael Murphy, who also co-authored Kajganić's appointment. There are no heroes in the BiH Prosecutor's Office; sometimes a spark of hope flashes, but it is quickly extinguished.

Bosnia and Herzegovina does not have a problem with its judiciary; it has a problem with the truth that the judiciary no longer serves justice, but politics. Those who, for the sake of their own promotion, preserving their positions, and a comfortable life, are ready to sell their last shred of professional integrity have long since settled in it.
