IGK: The Prosecutor's Office of Bosnia and Herzegovina should prosecute the unconstitutional and anti-state marking of January 9

(Patria) - The Institute for Research of Genocide Canada is seeking a concrete statement from the Chief Prosecutor of Bosnia and Herzegovina, Milanko Kajganić, on when the Prosecutor's Office will prosecute the unconstitutional and anti-state marking of the day of the entity Republika Srpska.

By the final judgment of February 26, 2007, the International Court of Justice in The Hague, with its judicial formulation that the army and police of the entity Republika Srpska designed and executed the genocide in Srebrenica, opened a legitimate and legal possibility for the complete legal challenge of the entity Republika Srpska. An integral part of the aforementioned legitimate and legal possibility is the challenge of seeking an advisory opinion from the International Court of Justice in The Hague in terms of legal clarification of the 2007 judgment. Giving an advisory opinion is one of the essential functions of the International Court of Justice, which goes through the United Nations General Assembly with the state sponsor of the advisory opinion. The Institute for Research of Genocide Canada has started working on this.

The anti-Bosnian, anti-state coalition in and outside Bosnia and Herzegovina, through a revision of the historical, judicial and scientific truth about the genocide in Srebrenica, seeks to impose the narrative that the entity Republika Srpska is a permanent state category. This is, in fact, the de facto beginning of the process of destroying the institutions of the state of Bosnia and Herzegovina, i.e., the constitutional and legal order of the state, which is a coup d'état. The marking of the day of the entity Republika Srpska is the result of the anti-state, illegal and anti-civilizational actions of the great-nationalist Serbian political option, which seeks to finish what it did not finish in the aggression and genocide against the Republic of Bosnia and Herzegovina. We remind that the judgments of international and national courts and numerous relevant scientific works have proven and established that January 9 can only be associated with criminal, anti-state activities, namely the aggression against the Republic of Bosnia and Herzegovina, the attempt to create a Greater Serbia, genocide, war crimes and crimes against humanity.

The Institute for Research of Genocide Canada has been calling for more than 10 years for January 9 to be marked as the day of the beginning of the aggression against the Republic of Bosnia and Herzegovina. In this way, we send a clear message to the anti-Bosnian, anti-state coalition that we know what the historical and legal facts are about that shameful, anti-civilizational celebration.

We are seeking a concrete statement from the Chief Prosecutor of Bosnia and Herzegovina, Milanko Kajganić, on the question of when the Prosecutor's Office will prosecute the unconstitutional and anti-state marking of the day of the entity Republika Srpska, based on the decision of the Constitutional Court of Bosnia and Herzegovina on the unconstitutionality of marking that day. Disrespect for the decisions of the Constitutional Court of Bosnia and Herzegovina is a direct coup d'état, but also a blow to the European Union, the United Nations and the international order, as well as peace and security in the world.

We warn that the participation of representatives of other states in the marking of the day of the entity Republika Srpska will be a clear message about their subversive activities against the state of Bosnia and Herzegovina and its citizens and peoples. Any representatives of other states at the aforementioned anti-state event will mean support for undermining the legal order, peace and stability, and support for the corruption personified by Milorad Dodik, the main organizer of the celebration of the day of the entity Republika Srpska. We will request from Canada and all other members of the Steering Board of the Peace Implementation Council in Bosnia and Herzegovina the introduction of sanctions for all those who encourage and realize the marking of the day of the entity Republika Srpska. Because by doing so, they directly attack the state of Bosnia and Herzegovina, an internationally recognized European state, a member of the United Nations.

The Government of Canada, back in 2018, in a statement on January 9, stated that the decisions of the Constitutional Court of Bosnia and Herzegovina are final and binding.

"We are aware of the discriminatory decision of the entity Republika Srpska regarding January 9, despite the decision of the Constitutional Court of Bosnia and Herzegovina, which ruled the celebration of January 9 as the day of the entity unconstitutional. In the communiqué of the Steering Board of the Peace Implementation Council, Canada and other members once again firmly reiterated that the decisions of the Constitutional Court are final and binding and requested from all levels of government in Bosnia and Herzegovina the mandatory implementation of the Constitutional Court's decision," the Canadian Government stated at the time.

It is shameful that in the so-called era of democracy, protection of human rights and freedoms, in the heart of united Europe, after "Never again!" after the Holocaust, after the largest crime in Europe after the Second World War, the aggression against the Republic of Bosnia and Herzegovina and the genocide against Bosniaks, the marking of the day of the entity Republika Srpska is allowed. One should not rely only on the international community, which continuously tolerates the dehumanizing celebration of the day of the entity whose institutions and political, military and police leaders have been convicted of genocide, war crimes and crimes against humanity. State institutions and responsible Bosnian-Herzegovinian leaders, together with patriots and friends of truth and justice, for whom January 9 recalls the horror of aggression and genocide and the attempt to destroy the state of Bosnia and Herzegovina, should, using all legal and political means, seek a ban on the shameful, anti-civilizational celebration of the day of the entity Republika Srpska. In this regard, we call on Christian Schmidt, the High Representative, to stop the violence against the legal order and citizens and, using the Bonn powers, ban the celebration of January 9 as the day of the entity Republika Srpska.
