Grubeša does not sign extradition order to Turkey: German spy arrested in BiH allegedly involved in drugs?

Only one extradition order from our country is currently being processed in the BiH Ministry of Justice, the Ministry confirmed to the news agency Patria.

As things stand, this case of extraditing a German citizen to Turkey will not pass peacefully.

According to our unofficial information, the BiH Minister of Justice Josip Grubeša refused to sign the extradition because some foreign diplomats in BiH asked him to. The Ministry of Justice, however, says it is a matter of procedure and does not deny that a diplomatic note has reached them.

- Regarding the extradition case of Eder Eberhard Josef, a German citizen sought by the Republic of Turkey, we inform you that the BiH Court has made a decision within its jurisdiction, but not a decision on extradition, for which it is not competent. Namely, the BiH Court decides on the fulfillment or non-fulfillment of the conditions for extradition, and the final Decision allowing or disallowing extradition is made by the Minister of Justice of Bosnia and Herzegovina in accordance with Article 46 of the Law on International Legal Assistance in Criminal Matters - says Marina Bakić, spokesperson for the BiH Ministry of Justice.

Patria's sources reveal that Eberhard Josef is allegedly a member of the German secret service, and that Germany's interest in him not being extradited to Turkey is significant. However, the Ministry of Justice justifies Grubeša's failure to sign the extradition differently.

- Given that this is a voluminous and complex case, as well as the fact that German authorities have expressed concern via a diplomatic note regarding the potential extradition of the wanted person to the Republic of Turkey, the Ministry of Justice of Bosnia and Herzegovina has already requested additional guarantees from the judicial authorities of Turkey regarding the submitted request, which it has not yet received. The Minister of Justice of Bosnia and Herzegovina will make a final Decision upon receipt of the response from the Republic of Turkey regarding the requested guarantees, after reviewing the entire case file - says Bakić.

Eder Eberhard Josef was arrested on an Interpol warrant. His detention expires on September 19, and he is allegedly involved in drug trafficking.

The Ministry of Justice points out that the Court does not issue any orders to the Ministry, nor are there any proceedings in that regard.

- In the case of extradition, the BiH Court decides on the fulfillment of the conditions for extradition, and the final decision according to the law and foreseen procedures is made by the BiH Minister of Justice. Currently, only one decision is under consideration. Therefore, there are no orders or decisions that have not been signed, but the legally foreseen review of extradition conditions is being carried out regularly - adds Bakić.
