Foča 1992: Krsto Dostić Sentenced to 10 Years for Multiple Rape of Pregnant Bosniak Woman

 

The Court of Bosnia and Herzegovina sentenced Krsto Dostić for participating in a widespread and systematic attack on the Bosniak population in the Foča area, as a member of the Army of Republika Srpska, for raping a pregnant woman, for which he was sentenced to ten years in prison, reports the Patria news agency.

Dostić was found guilty of raping S-1 on an unspecified date between April and August 1992 in the settlement of Ljubovići (Foča municipality) and threatening her not to tell anyone, and that in the following period he came two or three more times and committed rape.

The presiding judge of the Trial Chamber, Mira Smajlović, said that the Prosecutor's Office of Bosnia and Herzegovina had proven beyond reasonable doubt that the accused Dostić came to the house where the injured party S-1 was staying during the incriminated period.

“The Chamber considers the testimony of the injured party S-1 absolutely valid and sincere, which was confirmed by other witnesses in their testimonies,” said Smajlović.

The Trial Chamber considers that the defense evidence was not sufficient to challenge the allegations of the indictment.

In the opinion of the Trial Chamber, Dostić acted with direct intent, aware of the situation and consequences, and knowing about the widespread and systematic attack on civilians of Bosniak nationality, which was ongoing in the Foča area at that time.

By this verdict, Dostić is obliged to pay the injured party S-1 compensation for mental pain in the amount of 40,000 convertible marks (KM).

As mitigating circumstances, the Court considered that Dostić is a family man with two children, and as aggravating circumstances, the ruthlessness he showed in committing this act. An appeal against this verdict is possible.
