SARAJEVO, (Patria) - Former Rector of the University of Tuzla Enver Halilović, who was the keynote speaker at today's session of Krug 99 on the topic "Can RS and (not) extinguished HZ HB exist after the Hague verdicts?", stated that the Hague Tribunal, with its verdicts, has provided a framework and guidelines for future political and legal content and processes, not only in BiH, but also in the region.

- It told us what not to do today so as not to return to the war past, or rather, what we need to do to achieve a peaceful Bosnia. The founder of the Hague Tribunal for the former Yugoslavia, the United Nations Security Council, now has irrefutable evidence of what happened and how in BiH during the period 1992-1995, how and why Republika Srpska and the Republic of Herceg Bosna were formed, who formed them, what atrocities their political leaders, commanders, and other members of their armed forces committed, said Halilović, reports Oslobođenje.

According to him, the question that arises is what constitutes a joint criminal enterprise.

- We will see that the key qualification of the events in BiH, i.e., the war, the aggression against BiH in '92-'95, is precisely the action of two joint criminal enterprises, Halilović stated.

He added that a joint criminal enterprise is a criminal war project. It necessarily has a criminal goal and people united to achieve it.

He emphasized that the authorities and armed structures of the joint criminal enterprises, in pursuing the criminal goal, committed the most heinous war crimes for which they received sentences at the Hague Tribunal.

- The structure of the joint criminal enterprise against Bosnia and Herzegovina includes the following components: the highest authorities of Serbia and Croatia, the then presidents of Serbia and Croatia, commanders, highest members of military, police, and paramilitary formations of Serbia and Croatia, the highest authorities of the Croatian para-state created on the territory of BiH, the so-called Croatian Republic of Herceg Bosna, and the highest authorities of the Serb para-state formation on the territory of the Republic of BiH, the so-called Republic of the Serb People of BiH, later named Republika Srpska. It also includes commanders of the armed forces of the paramilitary and police formations of the aforementioned para-states. All of them committed a series of mass war crimes, and this was established by the Hague Tribunal, Halilović pointed out.

He added that some even committed the war crime of genocide, the highest form of war crime.

- Based on a broader and long-term engagement with these issues and based on what has been prepared in a broader study regarding this issue, generally formulated in the title, one can conclude, or in my opinion, it is necessary to conclude as follows: the Hague Tribunal has attributed war crimes of individuals within joint criminal enterprises on the territory of the Republic of Bosnia and Herzegovina to Serbia and Croatia and their para-states, the Republic of Srpska and the Republic of Herceg Bosna, Halilović stated.

According to him, "the verdicts of the Hague Tribunal call into question and deny the possibility of the existence of Republika Srpska, the verdicts of the Hague Tribunal call into question and deny the possibility of territorial, political, ethnic, and any rehabilitation of the Republic of Herceg Bosna".

- These are messages that all international officials, and especially the UN High Representative in BiH, should bear in mind, Halilović concluded.
