Dodik's response to Komšić full of lies about the Constitution, attack on the state must be prevented

SARAJEVO, (Patria) - The Chairman of the Presidency of Bosnia and Herzegovina (BiH), Željko Komšić, confirmed for Radio Free Europe (RSE) that a criminal complaint will be filed against the responsible persons, after the text of the Law on Medicines and Medical Devices of Republika Srpska (RS) was published in the Official Gazette of Republika Srpska (RS).

Komšić also emphasized that if the RS authorities continue like this and the BiH Prosecutor's Office does not react, then force will have to be used in the end.

"The RS authorities clearly do not care about any warnings from the international community. Now, more than ever, it is up to the Prosecutor's Office of Bosnia and Herzegovina. If this continues, tomorrow the same will happen with the Armed Forces of BiH, with the judiciary, and when it happens, then force will have to be used. If it is not responded to, it will mean that what they call a peaceful dissolution has been accepted," said Komšić.

Although Komšić did not mention the Serb member of the Presidency of BiH, Milorad Dodik, Dodik himself was the most called upon to respond to Komšić, thereby admitting that he, more than the RS authorities, stands behind the attacks on the constitutional order of Bosnia and Herzegovina.

In addition to accusing Komšić of not having "mentally left the war" and the Army of BiH even after 26 years, Dodik once again underlined his fundamental lie, namely that the steps he is taking are in accordance with the constitutional order and the Dayton Agreement.

"If what Komšić is saying is the best he knows, I inform him that the war is over and that Republika Srpska gained its rights through the Dayton Peace Agreement, which it defends in a peaceful and democratic way. If he continues to threaten with it, I expect the judiciary of the Federation of BiH to start doing its job as well," said Dodik.

Namely, RS did not gain any rights through the Dayton Agreement related to the National Assembly of Republika Srpska adopting laws by which the competencies of the state of Bosnia and Herzegovina are taken away. Nor did it gain the right to form para-institutions under that agreement. Quite the opposite.

Article III, paragraph 5 of the Constitution of Bosnia and Herzegovina clearly states that:

"Bosnia and Herzegovina shall assume jurisdiction over such matters as shall be agreed upon by the Entities; matters designated by Annexes 5 through 8 of the General Framework Agreement; or matters which are necessary for the preservation of the sovereignty, territorial integrity, political independence, and international subjectivity of Bosnia and Herzegovina, in accordance with the division of competencies among the institutions of Bosnia and Herzegovina. Additional institutions may be established as needed to carry out these competencies.".

Therefore, according to the Constitution of Bosnia and Herzegovina, the state of Bosnia and Herzegovina has taken over the competencies of the entities through decisions of the BiH Parliamentary Assembly. The return of these competencies is possible only through the Parliament, not through the entity assemblies. Therefore, Dodik's response to Komšić is completely meaningless, and serves the purpose of the lies that Dodik standardly uses, and he must be prevented from doing so, as well as from attacking the state, because the state has no price.
