Will the truth about Dženan Memić's murder ever be known

The Security Commission of the Sarajevo Canton Assembly initiated disciplinary proceedings against police commissioner Vahid Ćosić in early August for providing inaccurate information and concealing facts about the manner of performing official duties in the case of Dženan Memić's murder. The Minister of Police of KS, Vedran Mulabdić, acted on this conclusion and made a decision to initiate disciplinary proceedings against Ćosić, writes the BiH news agency Patria.

Such a conclusion was reached after a detailed analysis of the activities carried out by the Security Commission and its Ad hoc body for the "Dženan Memić" case. From the very beginning (February 2016), this case has been shrouded in mystery, and it is indicative that the case has already received a judicial epilogue and that Ljubo and Bekrija Seferović are on trial. At the hearing on the plea of guilt in the case of Dženan Memić, Ljubo and Bekrija Seferović pleaded not guilty.

Ljubo Seferović is accused of a serious criminal offense against public traffic safety and the criminal offense of failure to provide assistance to a person injured in a traffic accident. He pleaded not guilty.

His father, Bekrija Seferović, who is defending himself from freedom, also pleaded not guilty to the criminal offense of obstructing evidence.

The KS Prosecutor's Office initially opened an investigation into the murder, and in August reclassified the offense as a serious criminal offense against public traffic safety.

- The current situation regarding the disciplinary report will not affect the fairness and legal proceedings - claims the KS Prosecutor's Office.

However, it remains unclear why the KS Prosecutor's Office did not file criminal charges against those who provided false information in the investigation, and among them is certainly Alisa Mutap. The girlfriend of the late Memić, who was with him on the night he died.

At the next hearing, Mutap will appear as a witness, and there are many unexplained circumstances. Whom did she call to help Dženan, what happened that fateful night, why did she change her statement?

Why did the KS Prosecutor's Office not file criminal charges against the police officer and commissioner Ćosić himself, because providing false information is a criminal offense. We did not receive an answer from the KS Prosecutor's Office to this part of the inquiry.

- Legally, the mentioned procedure cannot affect the court proceedings conducted before the Cantonal Court in Sarajevo based on the confirmed indictment of the Cantonal Prosecutor's Office of Sarajevo Canton against Ljubo Seferović, accused of a serious criminal offense against public traffic safety and failure to provide assistance to an injured person after a traffic accident, and against Bekrija Seferović, accused of the criminal offense of obstructing evidence.

We remind you that the Chief Cantonal Prosecutor warned from the beginning of this case about the actions taken by police officers and the fact that one of them gave two different statements about the same event, which is why actions were requested and responsibility of that police officer was to be determined by the commissioner. At the same time, we inform you that this Prosecutor's Office has been operating in accordance with the Law and other regulations from the beginning, which resulted in the filing of an indictment - said Azra Bavčić, spokesperson for the KS Prosecutor's Office for Patria.

Dženan Memić's father, Muriz Memić, remains persistent in his fight for the truth about his son's death and announces that he will organize new protests because he is dissatisfied with the investigation, still claiming that his son was murdered.

- The MUP has not yet submitted any documentation, and I was told that the Commission is still doing its job. Details about its work will be presented at the KS Assembly, which is scheduled for October 18. It is completely illogical that the KS Prosecutor's Office initiated the trial while the investigation is still not completed - Memić stated recently.

And it is absolutely true that there are so many illogicalities in this case that even the best legal experts have no answer to these questions. What is the gap between the Prosecutor's Office and the police.

How is it possible that the Prosecutor's Office responsibly refers to laws and regulations, well, laws are the same for everyone. However, the question is whether the truth will be revealed and who is hiding. This situation best shows the absurdities of the long-ago spoken sentence "everything was done according to the law". Perhaps it was, but it also shows the shortcomings and all the loopholes in the law, so we increasingly need amendments to the law.

The Chief Prosecutor of the KS Prosecutor's Office, Dalida Burzić, has repeatedly stated herself that the investigation has been jeopardized from the beginning, that there has been information leakage.

- In the investigation phase, there is no transparency and evidence that has not been presented to the court is not discussed. This case showed what jeopardizing an investigation means because it was jeopardized from the very beginning. The investigation would otherwise have been completed much earlier. The Prosecutor's Office will insist on prosecuting those who jeopardized the investigation. We refrained from any comments, and in the end, we successfully completed the investigation and filed an indictment. The court is the only place where evidence is discussed, and the court is the one that makes the final decision - Burzić said.

The public, and primarily the family, have the right to know the answers to all these questions.

If the Prosecutor's Office, as it claims, has been operating in accordance with the Law and other regulations from the beginning, which resulted in the filing of an indictment, then file indictments against those who lied, because that is a criminal offense, isn't it?
