BH-Gas: FBiH Government Decree Regulates the Gas Industry Sector in the Federation

BH-Gas d.o.o. operates in accordance with the valid Decree on the Organization and Regulation of the Gas Industry Sector, which represents the only positive legal regulation related to the gas industry on the territory of the Federation of Bosnia and Herzegovina, it was announced from this company, reports the Patria news agency.  

Article 59 of the aforementioned Decree designates the companies Energoinvest d.d. Sarajevo and BH-Gas d.o.o. Sarajevo for performing tasks related to gas supply to consumers in the FBiH, while Article 10 of the Decree designates BH-Gas d.o.o. Sarajevo as the operator of the gas transmission system in the FBiH.

Namely, until the adoption of the gas law of Bosnia and Herzegovina, which should also regulate the activity of transmission, in the Federation of BiH, the valid Decree, pending harmonization with state authorities, regulates the area of the gas industry on the territory of the Federation of BiH.

Also, we emphasize that at this moment, in accordance with long-standing international purchase agreements (Gazprom Export from the Russian Federation) and transport agreements through Hungary and Serbia, BH-Gas d.o.o. performs both the transmission and supply of gas to Bosnia and Herzegovina.

All activities initiated in recent times, including the initiative of the company GAS-RES d.o.o. Banja Luka regarding access to the transmission system, are the best indicator of the necessity of adopting gas regulations at the state level, adopting a framework law on gas at the level of BiH, i.e., granting certain regulatory competencies to a body at the BiH level, which would also serve as a basis for the adoption and mutual harmonization of entity legal regulations, thereby ultimately creating the prerequisites for establishing equal conditions for the participation of entities in the BiH market, the statement reads.
