The High Judicial and Prosecutorial Council (HJPC) of Bosnia and Herzegovina will reach a conclusion at today's session regarding the letters it received after the BiH Prosecutor's Office refused to allow the OSCE to inspect case files of war crimes. The HJPC has a different opinion on the inspection of files than the Prosecutor's Office, writes the Patria news agency.

Members of the HJPC believe that the OSCE's request to conduct an independent analysis of war crimes cases of the Prosecutor's Office and the Court of BiH is in line with their opinion and that of the Court of BiH from November 2006, which allows the OSCE access to the files, while the Prosecutor's Office's decision remained disputed.

In the letter from the College of Prosecutors, it is stated that access to the files upon the OSCE's request is not approved, citing the independence of the judiciary and the consequences for the further work of this institution in war crimes cases.

The question arises: is the OSCE seriously violating its mandate in Bosnia and Herzegovina, established by the Dayton Peace Agreement, and stepping outside the framework of its activities?

Furthermore, if this organization advocates and promotes the independence of all institutions in BiH, including the judiciary, the question is whether its efforts to control the work of one department of the BiH Prosecutor's Office also call into question the sovereignty of this state.

There is certainly also the aspect of humiliating judges and prosecutors working in the state Prosecutor's Office and Court, who are shown through this approach that they are not trusted.

Although, unfortunately, politics still influences the work of domestic judicial institutions, this move by the OSCE now unequivocally shows that foreigners also want to interfere directly and publicly.

In this way, Milorad Dodik will be handed yet another argument that he constantly waves around, namely that state judicial institutions are controlled by foreigners and that they manage judges and prosecutors. This is precisely Dodik's main trump card on the basis of which he is also seeking a referendum in the RS.

Who is Joan Korner, who is supposed to conduct the analysis of war crimes cases? What are her references? Where has she worked so far? The BiH public is deprived of these answers, as her name is heard for the first time.

Let us recall how numerous „foreign experts“ roamed this country in the years behind us, directly interfering in the work of the judiciary, which seems independent of BiH, but certain centers of power have certainly tried to make it dependent on foreign factors.

About ten years ago, the infamous Oscar roamed around BiH, whose name everyone, from the police to prosecutors and judges, uttered with fear, only for Zagreb's Globus to eventually reveal that it was a classic spy.

Who can then guarantee that Joan Korner is not a female spy (who knows whose and for whose interests), and who is supposed to review war crimes cases containing numerous statements of protected witnesses and secret investigations?

Moore has long been a lobbyist for Dodik's and Čović's interests

Recently, the well-known journalist Slobodan Vasković wrote a blog dedicated precisely to the OSCE Mission in BiH, more specifically to its head, Jonathan Moore. Among other things, Vasković wrote:

„Moore has introduced the OSCE into a new phase of operation in BiH, turning this organization into an instrument of local leaders and using his position at its helm for personal lobbying goals.

Moore has, simply put, privatized the OSCE, put it in the service of his personal interests, and completely dragged it into the mud and conflicts of local political elites.

This is nothing new when it comes to Moore; he has long been a lobbyist for Dodik's and Čović's interests. Since that is the case, it would have been much more honest for him to have founded a lobbying firm, publicly charged for his work, rather than using the OSCE to recompose the government in BiH and thus completely compromise the work of this organization.“
