Damir Alagić, the lawyer of a protected witness in the crimes against Bosniaks in Višegrad, filed a criminal complaint yesterday against unknown persons for endangering the witness's safety, Alagić confirmed for the BiH news agency Patria (NAP). He warns that the latest attack could completely prevent the further prosecution of war crimes, as it shows that witnesses do not have adequate protection.
- I thought the BiH Prosecutor's Office would seriously do its job in such an important case. But I was wrong. Now the question is who will testify further after this – Alagić added.
According to available information, Nikola Krsmanović attempted to murder a protected witness against Dragan Šekarić, who is charged with crimes against Bosniak civilians in Višegrad and Goražde.
- I have filed a criminal complaint with the BiH Prosecutor's Office against unknown persons for what happened, let the investigation show who is responsible. Everyone failed in this case, both the Court and the Prosecutor's Office – says Alagić.
He further adds that this witness had already been attacked. At that time, they also contacted SIPA, which is responsible for witness protection, but Alagić holds the BiH Court and Prosecutor's Office more responsible in this case, as they have not yet completed all procedures for declaring the witness protected.
- SIPA did its part, although no paperwork reached them. Then I informed both the BiH Prosecutor's Office and the Witness Protection Department at SIPA, and two operatives came and did their job despite the fact that they had no coverage, because the procedure takes several months – Alagić added.
The lawyer further notes that it is unclear to him how it is possible for the witness protection process to take several months as in this case.
- How long does the BiH Court need to do that. I have been a lawyer for ten years and nothing is clear to me. If you have two protected witnesses in a war crimes case and you know that these persons were in direct contact with a convicted war criminal, you know that they were located in the Dominican Republic and you have all that information, and then you allow an attack to happen – Alagić added for NAP.
