The Prosecutor's Office of Bosnia and Herzegovina has filed an indictment against lawyer Nina Kisić and SIPA official Dženana Omerhodžić. This news was first reported by RTRS. Logically, because Kisić and Omerhodžić are charged with the criminal offense of "False Reporting," to the detriment of a prosecutor from the state prosecution and a member of SIPA.
RTRS reported that the accused are charged with the aforementioned criminal offense to the detriment of prosecutor Miroslav Janjić and head of the SIPA Department Novak Mijović, in order to discredit them in a case related to war crimes against Serbs.
The case allegedly relates to the commander of the Army of the Republic of Bosnia and Herzegovina (ARBiH) Naser Orić. It is speculated that Kisić and Omerhodžić wrote anonymous false criminal complaints against Janjić and Mijović for alleged bribery.
And now, after I have summarized the news that was published yesterday, the real question arises. Do holders of judicial functions have the right to daily 'whining' that the pressure on them is unbearable, if we consider that, for example, no one has raised the issue of accountability for prosecutors, and if we are to be honest, even for Janjić himself for failed cases at the Court of BiH.
Specifically, for Naser Orić. Fabricated, politically motivated indictments cannot end at the Court of BiH in any other way than with acquittals. However, RTRS and similar media will call such a court 'Muslim'. It is not the first time, nor will it be the last. Janjić himself, after the final acquittal for Orić, will say:
“For me to be present at the pronouncement, a verdict would have to be delivered. For a verdict to be delivered, there would have to be a court. For the court to be the Court of BiH, there should be Serbs in the courtroom as well,” Janjić told BIRN BiH after the verdict.
This reaction was condemned the same day by the State Prosecutor's Office, which stated that "the expressed position of prosecutor Janjić is not the position of the Prosecutor's Office of BiH." However, Janjić still works in the Prosecutor's Office of BiH; if he was punished, it was symbolic, monetary.
And who will restore the dignity, health, and money of those falsely accused, who were dragged through the courts for years. The same Orić, who, contrary to the basic postulate of law – was tried twice for the same crime. Once in The Hague, once in BiH. Both times he was acquitted.
Orić's defense established that numerous alleged witnesses were interrogated in Serbia and gave statements under duress. At the same time, it became known that the only remaining witness on whom the indictment relies was interrogated in Serbia, so there is a completely justified doubt about his credibility.
This allegedly key witness gave three completely different statements. What further casts doubt on such testimony is that he only speaks about the events from the indictment in his last statement, given in August 2015. Before that, he did not even mention Zalazje.
However, that is all far behind us. But Serbia and the Serbian lobby in the judiciary in BiH do not want an 'acquitted Orić'. Now, they are certainly trying, by filing charges against Kisić and Omerhodžić, to create an alibi for Janjić, in order to prove their premise about a 'Muslim court'!
The story about threats to prosecutor Miroslav Janjić remained well-remembered in the public. Unfortunately, at that time, many media outlets, in their reporting, failed to report that this same man also sent threats to Naser Orić and his lawyer Lejla Čović. Prosecutor Janjić knows very well who is being referred to.
Threats to prosecutor Janjić, but also to Orić and his lawyer, were sent by Samir Avdić, a former "key witness" of prosecutor Janjić against Naser Orić. In the threats that Patria had the opportunity to see, Avdić clearly states that he and prosecutor Janjić know each other well. They met in Belgrade when Avdić was being prepared to testify against Orić. Of course, the HJPC never investigated or sanctioned this.
In fact, the indictment against Kisić and Omerhodžić is just another sign that Serbia, just as in the current Dobrovoljačka case, will not give up on prosecuting Orić, as well as all other members of the ARBiH and MUP RBiH (remember Edin Vranjo, Osman Osmanović, Husein Mujanović...) in order to achieve historical revisionism. The BiH judiciary, as well as the Revised State Strategy for Prosecuting War Crimes, and the treasonous Extradition Treaty between Serbia and BiH, where they protected war criminals and Serbia, are helping them significantly in this.
Now, all that remains for them is to prosecute members of the ARBiH, which is proven daily, and who have no one to protect them, while prosecutors and judges run around world embassies complaining about pressure.
