
Denis Bećirović, a representative in the House of Representatives of the BiH Parliament and Vice-President of the SDP BiH, posed 11 questions to the Serbian Prime Minister regarding the open disrespect of the decisions of the Constitutional Court of BiH and the denial of the sovereignty of Bosnia and Herzegovina, reports the BiH news agency Patria.
Mr. Vučić,
Given that you have publicly announced that on January 9, 2016, you will bring the entire Government of the Republic of Serbia to the state territory of Bosnia and Herzegovina (to the Bosnian city of Banja Luka) to mark this discriminatory, unconstitutional, and anti-Dayton date, as a legally elected state representative who has taken an oath to advocate for the equality of all citizens and peoples of Bosnia and Herzegovina, I publicly pose to you eleven (11) questions:
1) Mr. Vučić, at the meeting held on May 12, 2014, in the building of the Parliamentary Assembly of Bosnia and Herzegovina, which I personally attended as one of the leaders of the state parliament of Bosnia and Herzegovina, I was a witness to your statement that you would respect the sovereignty of Bosnia and Herzegovina and the decisions of its legal bodies. Why, Mr. Vučić, after numerous statements and twenty years after the signing of the Dayton Peace Agreement, have you decided to directly and flagrantly violate its provisions on January 9, 2016, and disrespect the final and binding decisions of the legal and legitimate Constitutional Court of Bosnia and Herzegovina?
2) Are you aware that on January 9, 1992, contrary to the then-valid domestic and international law, an illegal and unlawful decision was made to, against the will of the majority of the inhabitants of Bosnia and Herzegovina, declare more than half of the state territory of Bosnia and Herzegovina as an integral part of Serbia, i.e., the FRY, for the first time in the thousand-year history of our country? Is it clear to you, Prime Minister of Serbia, that your arrival is the clearest and most open anti-Dayton act in the last twenty years, by which you publicly manifest that officials of Serbia have not yet abandoned the criminal project of creating Greater Serbia at the expense of the state of Bosnia and Herzegovina?
3) Mr. Vučić, when the Serbian judiciary initiated fabricated indictments and arrested BiH patriots, such as Ejup Ganić, Jovan Divjak, Ilija Jurišić, you and other Serbian officials said that you would not interfere with the work of the judiciary and that you would respect court decisions. How is it that now, when the Constitutional Court of Bosnia and Herzegovina has made a final and binding decision, you are publicly announcing your active participation in denying and disrespecting legal and legitimate court decisions?
4) Mr. Vučić, January 9 has no legal basis in the Dayton Peace Agreement and the BiH Constitution, and marking this date represents a provocation for the state of BiH and the entire international community. Is the goal of your announced arrival to intensify the dangerous policy of denying the historical and legal fact that the BiH entity RS is an administrative-territorial unit within the indivisible state of Bosnia and Herzegovina, which exists as such only from the signing of the Dayton Peace Agreement? The Bosnian-Herzegovinian entities FBiH and RS were recognized as entities within the state of Bosnia and Herzegovina only in Dayton, and as such, they have no continuity and are not historically and democratically formed administrative-territorial units.
5) Are you aware that any attempt to establish continuity of the BiH entity RS with illegal, unrecognized, and self-proclaimed creations on the state territory of Bosnia and Herzegovina is unacceptable, legally unfounded, and extremely counterproductive for the policy of building good neighborly relations between our two countries?
6) For what reasons do you agree to participate in marking an illegal and offensive date for modern Europe and the United Nations? Namely, we all know that this date represents the officialization of the policy that conceived and systematically carried out systematic mass crimes, ethnic cleansing, camps, mass killings of civilians, mass graves, and genocide in Srebrenica. This policy was, among other things, conceived in unconstitutional and illegal documents for the formation of the so-called Serbian state on the territory of Bosnia and Herzegovina precisely on January 9.
7) Do you know, Mr. Vučić, that to date, over a thousand years of prison sentences have been handed down to the designers and executors of the policy of destroying the state of Bosnia and Herzegovina in the Hague Tribunal and courts in BiH and Europe? For genocide and other crimes in Srebrenica alone, 27 instigators and perpetrators have been sentenced to more than 550 years in prison so far. The main culprits for planning and implementing such a policy, Radovan Karadžić and Ratko Mladić, are still on trial in The Hague, and death prevented the sentencing of the former President of the Republic of Serbia, Slobodan Milošević.
8) Why have you decided to ignore the fact that the European Commission for Democracy through Law, better known as the Venice Commission, at its 96th plenary session on October 11 and 12, 2013, adopted an opinion on the compliance of the RS Day with anti-discriminatory standards of the Council of Europe, i.e., the European Convention on Human Rights and Fundamental Freedoms, concluding that the celebration of January 9 as the RS Day is a discriminatory act towards other peoples in that part of Bosnia and Herzegovina? The choice of January 9 as the RS Day is inspired by unconstitutional and illegal events significant only for one people, which is an insult to other peoples and is not in line with basic democratic values and postulates. Such a policy is not in line with values such as dialogue, tolerance, mutual understanding, and equality, which should be the basis for choosing an entity day, according to the Venice Commission.
9) Until when will you, on the one hand, pursue a policy of denial, justification, and negation of the globally established and adjudicated genocide against Bosniaks in Srebrenica, and, on the other hand, celebrate dates and the criminal policy created and implemented by Slobodan Milošević, Radovan Karadžić, and Ratko Mladić? Have you, Mr. Vučić, forgotten the Judgment of the International Court of Justice from 2007, which ruled that the Republic of Serbia is the only country in Europe that has violated the Convention on the Prevention and Punishment of the Crime of Genocide after World War II?
10) Prime Minister of Serbia, after the experiences of your country from the beginning of the 19th to the end of the 20th century – the Principality of Serbia, the Kingdom of Serbia, Serbia after the Balkan Wars, the Kingdom of Yugoslavia, the Socialist Federal Republic of Yugoslavia, Serbia and Montenegro – has the dominant political elite in Serbia not understood that the Greater Serbia project cannot be realized either in war or in peace? Has it not finally come time to make a clear distinction between patriarchal and modern consciousness? Is it possible that a part of the political elite in Serbia, even at the beginning of the 21st century, has not yet answered the question that has long occupied the attention of a part of the Serbian political and intellectual elite – what kind of state, or how big a state?
11) I assume, Mr. Vučić, that you have read the book "Philosophy of the Palanka," which is one of the key books for understanding the bloody chaos of the last decade of the 20th century. How long will the spirit of the palanka destroy the lives of new generations and innocent people? To avoid misunderstanding, I agree with the words of the great scientist and man, Dr. Radomir Konstantinović, a palanka is anywhere where there is no stopping in front of the mirror due to conscience, and it is neither spatially nor temporally defined.
I want to believe that the future of our countries lies in genuine mutual respect and understanding. It is time for you too to finally start building an honest and sincere policy towards Bosnia and Herzegovina. Do not do to Bosnia and Herzegovina what you would not want done to Serbia.
Finally, as the current Prime Minister of Serbia, I remind you that the aforementioned questions are posed by the current state representative of Bosnia and Herzegovina, for whom one Bosniak has always been and remains equally important and valuable as one Serb, Croat, Bosniak, Roma, Jew, or any other human being.
