It was not so long ago, in April 2023, when members of the Presidency of Bosnia and Herzegovina (Željko Komšić and Denis Bećirović) and presidents of parliamentary political parties at the state and entity level signed a Joint Declaration on state property of Bosnia and Herzegovina.
In addition to Komšić and Bećirović, the declaration was signed by the president of the Party of Democratic Action (SDA) Bakir Izetbegović, the president of the Social Democratic Party (SDP) of Bosnia and Herzegovina Nermin Nikšić, the president of the People and Justice Party (NiP) Elmedin Konaković, the president of Our Party Edin Forto, the president of the People's European Alliance (NES) Nermin Ogrešević, and the president of the Party for Bosnia and Herzegovina Semir Efendić.
Today, the public learns that the Government of the Federation of BiH excluded state institutions when making decisions on the disposal of state property, i.e., state forests being cleared in Vareš by the British company Adriatic Metals.
The State Attorney's Office was excluded from the decision-making process regarding the allocation of state land, i.e., the change of purpose of state land. In the explanation of the decision, the Federal Prime Minister Nermin Nikšić (one of the signatories of the declaration on state property) stated that he had the consent of the High Representative Christian Schmidt for the exclusion of the BiH Attorney's Office.
Thus, the red lines they previously spoke about have been erased, and space has been opened for Milorad Dodik to have the RS Government make a similar decision on the repurposing of land for the construction of the Buk Bijela hydroelectric plant.
In the declaration, which is evidently just a dead letter on paper, the signatories stated that a state law on property should ensure efficient and transparent management and disposal of state property of Bosnia and Herzegovina, and today, a few months later, we can conclude that such a law will not even be necessary!
However, experts warn that Nermin Nikšić is making a decision that is not in accordance with Article 8, paragraph (3) of the Law on Real Rights of the FBiH, which clearly states that owners and holders of other real rights over goods of general interest are obliged to exercise their rights in accordance with the manner of use and utilization prescribed by special laws.
Therefore, first, it is necessary to determine who the owner is, and second, that owner must use the forest land in accordance with the manner of use and utilization, or there is no forest clearing, unless it is a matter of safety, which it is not.
And so, in just a few months since the signing of the declaration, which mostly criticizes the behavior of the authorities in the Republika Srpska, a 'Miloradization' of federal politicians has occurred. Admittedly, one must not forget the agreement signed by the coalition at the state level, consisting of the parties of the troika (SDP, NiP, Our Party), as well as SNSD and HDZ, which, it seems, is being slowly implemented.
The partners in this agreement committed to creating a new program of economic reforms for Bosnia and Herzegovina, and are committed to the rapid passage and approval of investment projects at all levels of government.
It appears they are implementing this passage by excluding state institutions from important processes, all on the path of the concept of a composed state of Bosnia and Herzegovina!
Because on November 26, I was deeply convinced that Prime Minister Nikšić, appearing on Face TV unconsciously mentioned in a slip of the tongue the creation of a 'joint state'. Today, I am not sure about the unconsciousness of such words, because often the tongue speaks the truth, and when deeds prove it, then every doubt is dispelled.
