Dragan Čović is breaking the law, international standards, and the constitution, why is no one reacting!?

(Patria) - We hear these days how Dragan Čović, president of HDZ and the NGO HNS, is saying it's not too late for amendments to the Election Law of Bosnia and Herzegovina, announcing that in the coming months he will speak about it in several foreign destinations.

Of course, his idea relates to the creation of a Third Entity or a third electoral unit, which would be a formal form of that same Third Entity, all with the aim of taking control of the Presidency of Bosnia and Herzegovina, after he has taken control of everything he could wish for through the "compromises" of the Trojka. There are at least two problems in his story.

The first relates to the document of the Venice Commission, not an opinion, but a document titled "Code of Good Practice in Electoral Matters" which clearly and unequivocally states that electoral rules cannot be changed in the period of one year before the elections are held.

In this regard, II/2b of the Venice Commission states: "The fundamental elements of the electoral law, in particular the electoral system itself, the composition of electoral commissions and the delimitation of electoral districts, should not be subject to amendment less than one year before elections..."

When we look at this, it is quite clear that what Dragan Čović is asking for is in complete opposition to what European electoral standards are, as stated in this document of the Venice Commission. Dragan Čović should know, which he probably does but "wisely" remains silent, that among the 14 key priorities for Bosnia and Herzegovina's membership in the European Union, it clearly states that electoral legislation should be harmonized with European standards and in the way that European standards prescribe.

Therefore, it is not possible to change electoral rules in the period of one year before the elections themselves are held, so the question arises, what will Dragan Čović actually tell some representatives of the international community?

This brings us to the second important issue. Dragan Čović does not have the authority to act in foreign policy, nor does his position as Deputy Speaker of the House of Peoples of Bosnia and Herzegovina grant him such authority, nor does his position as party president or head of a non-governmental organization grant him such authority.

Acting outside of constitutionally and legally granted authorities is a serious criminal offense. Just as an attack on the constitutional order is a criminal offense by attempting to lobby or propagate the idea of a Third Entity. Media controlled, or rather, under the iron fist of the HDZ, accuse Slaven Kovačević, a candidate for member of the Presidency of Bosnia and Herzegovina, of attacking the constitutional order by advocating for the equality of people or a civic state, which is a blatant falsehood, because in Article II/2 of the Constitution of Bosnia and Herzegovina itself, it clearly states that the European Convention on Human Rights is directly applied in Bosnia and Herzegovina and that its application is above any other law.

It is precisely this European Convention on Human Rights that speaks exclusively of the equality of people and the prohibition of discrimination, which then clearly indicates that Kovačević is acting in accordance with the current constitution. In contrast to this are the ideas of Dragan Čović and the HDZ about some imagined "legitimate representation of constituent peoples," which in its essence contains elements of discrimination and is in complete opposition to the Constitution of Bosnia and Herzegovina.

Their claims that the Constitutional Court of Bosnia and Herzegovina determined this in the "Ljubić" decision are incorrect, because it only refers to the system of electing delegates to the House of Peoples of the Federation of Bosnia and Herzegovina and nothing else.

Part of Ljubić's request regarding the election of members of the Presidency of Bosnia and Herzegovina was rejected.

If we add to this the ideas about a Third Entity, then it is quite clear that Čović and the HDZ are directly attacking the constitutional order of this country. And, probably, due to full control over the judicial system, which is the perception of the general public, he regularly goes unpunished for such views, while he should be held accountable.

The conclusion is simple. Čović is again manipulating, deliberately concealing important acts of international law, and in doing so, exceeding his prescribed competencies, which is a criminal offense. He would even connect all this with the Southern Interconnection, counting, obviously, but at the same time very wrongly, on the ignorance of the Americans, who have unequivocally stated that they will not agree to any blackmail.

This is about only one thing. Are there those in Bosnia and Herzegovina who are protected from the rule of law, even though Milorad Dodik was finally convicted, while Čović is still allowed to do all sorts of things. Until when? We will see.
