How far Bosnia and Herzegovina is from true democracy and legal certainty can be found in news from America, which says that Judge Aileen Cannon dismissed the case that Special Counsel of the U.S. Department of Justice Jack Smith is leading against former U.S. President Donald Trump regarding his handling of classified state documents, and the reason, as she stated, is the unlawful appointment of the prosecutor.
Imagine that amount of justice in Bosnia and Herzegovina. It is hard to imagine, because it is known that no one in BiH cares about justice, and the BiH Prosecutor's Office most often works on the principle of clearing the drawer of cases that are in the focus of political dissidents or even foreign factors, as was the case with 'Respirators'.
Everyone knows everything about the appointments of prosecutors and staff in the judiciary, it is known who is whose (!?), it is an open secret who is with whom, and who is against whom, and advancement in the judiciary largely depends on how you worked in the interest of the powerful, who will support your appointment tomorrow.
And while in America such a big case is dismissed because the appointment of the prosecutor was not in accordance with the Constitution, in BiH no one even looked at the media reports, let alone tried to investigate how Milanko Kajganić was appointed.
Everyone was satisfied with the congratulatory message from U.S. Ambassador Michael Murphy to forget how, as Istraga wrote, the official trip of Admir Suljagić to Laktaši and Banja Luka determined the majority in the High Judicial and Prosecutorial Council that appointed Milanko Kajganić as Chief Prosecutor of the BiH Prosecutor's Office.
On that trip, the Director of the HJPC Secretariat promised judicial personnel from Republika Srpska that he would convince Halil Lagumdžija to change his position regarding Kajganić's election.
And indeed, although Halil Lagumdžija, the head of the HJPC, was not in favor of Kajganić's election, he 'changed his mind' and supported his appointment.
Because until Admir Suljagić traveled to Banja Luka and Laktaši, Lagumdžija was convincing his friends and HJPC colleagues that Kajganić would not pass. Then an agreement followed with Srđan Forca, a member of the HJPC from Banja Luka and the informal 'boss' of Serbian cadres in the HJPC.
You can recall the entire story of that appointment at this link.
In the meantime, the second year of Kajganić's appointment and agony for many defenders of BiH is passing, while genocide deniers sleep peacefully, just like the fugitive indictees – members of the Army of Republika Srpska!
The question of the objectivity of the BiH Prosecutor's Office was answered long ago – it does not exist.
Because how else to explain that, for example, in the indictment known as Jošanica, the word 'genocide' against the Serbian population is even mentioned, which has never been proven before international courts.
On the other hand, the Dobrovoljačka case, which also ended in The Hague, because the JNA column was declared a legitimate military target, is a case personally signed by Kajganić (it is widely suspected that this is why he became chief prosecutor), in which the exact opposite is claimed, with the fact that Alija Izetbegović, according to the BiH Prosecutor's Office, was considered a free man on May 2 and 3!
The intentions of rewriting history and relativizing crimes committed on the territory of Bosnia and Herzegovina are very clear.
It is no different with high corruption cases; in fact, there are none, and if there are any, Kajganić says which ones they are. So, is the Respirator case the only thing that was sought from the judiciary, so that the 'heroes of the month' would be respected as much as possible.
Once you become the hero of the month of the U.S. Embassy in BiH, do you stop working or wait for new orders from your bosses, because it is impossible that in a country where corruption flourishes, everything starts and ends with Fadil Novalić and others!
America is truly far away, and with such a judiciary, the European Union does not seem any closer!
