
(Patria) - The Constitutional Court of Bosnia and Herzegovina has not yet delivered its decision on the appeals of Fikret Hodžić, Fadil Novalić, and Fahrudin Solak, as well as the legal entity "F. H. Srebrena malina" to the defense teams or the Court of Bosnia and Herzegovina.
According to Patria's findings, this is expected in the next two to three days, as the dissenting opinion of one of the judges of the Constitutional Court of Bosnia and Herzegovina is still awaited.
We remind you that the Constitutional Court of Bosnia and Herzegovina accepted the appeal of Fikret Hodžić, who was finally sentenced to five years in prison for abuse of office during the procurement of respirators during the coronavirus pandemic, and the legal entity "F. H. Srebrena malina", and decided to return the case to the Court of Bosnia and Herzegovina in the part where the violation of the right to a fair trial needs to be rectified.
In practice, this means that Fikret Hodžić will be released, and the final decision of the Court of Bosnia and Herzegovina will be known after they read the decision of the Constitutional Court of Bosnia and Herzegovina. Otherwise, according to Patria's sources, there is considerable chaos at the Court of Bosnia and Herzegovina, as they are aware of the failures and gross procedural violations.
Hodžić was sentenced to five years in prison on a subsequently added count of abuse of office, while he was acquitted on the original four counts of the indictment.
"There is almost fear of what will come in the letter from the Constitutional Court of Bosnia and Herzegovina. Many were well aware of the gross violations in this process even before this decision of the Constitutional Court of Bosnia and Herzegovina," says a source from the Court of Bosnia and Herzegovina.
Unlike Fikret Hodžić, the Constitutional Court of Bosnia and Herzegovina partially accepted the appeal of former Federal Prime Minister Fadil Novalić and former Director of the Federal Civil Protection Administration (FUCZ) Fahrudin Solak, who were sentenced to four and six years in prison, respectively, in the same case, and determined a violation of the right to a fair trial regarding the presumption of innocence of these appellants in the process of establishing the "criminal charge" in connection with statements made by certain public officials during the criminal proceedings. The remaining claims of the appeals were rejected.
