(Patria) - The National Assembly of the RS adopted a set of controversial laws tonight, which were submitted to the procedure under an urgent process by the Government of the RS.
Opposition MPs, who attended the debate, left the session before the vote, writes Faktor.
The Law on Non-Application of Laws and Prohibition of the Operation of Unconstitutional Institutions of BiH, the Law on the High Judicial and Prosecutorial Council of the RS, the Law on Amendments to the Criminal Code of the RS, and the Law on a Special Register and Public Transparency of Non-Profit Organizations were adopted.
It is characteristic that during the parliamentary debate, only SNSD MPs engaged in defending the controversial legal solutions, and no one from other parties forming the ruling majority did.
On the other hand, opposition MPs criticized these laws, warning of possible consequences. SDS stated that this is a direct attack on the Dayton Agreement and the constitutions of BiH and the RS.
The President of the RS, Milorad Dodik, stated that this is the "right momentum" to pass the laws and that the RS has been preparing for this for a long time.
After adoption in the RS National Assembly, the legal procedure will continue in the Council of Peoples of the RS and likely in the Constitutional Court of the RS if any of the peoples' caucuses file a veto.
The Law on Non-Application of Laws and Prohibition of the Operation of Unconstitutional Institutions of BiH states that the Law on the Court of BiH, the Law on the Prosecutor's Office of BiH, the Law on the HJPC of BiH, and the Law on the State Investigation and Protection Agency (SIPA) will not be applied or enforced in the territory of the RS.
"The operation and actions of institutions whose work is regulated by Articles 2 to 4 of this law are prohibited in the territory of the RS," the law states.
It is stated that the competent institutions and bodies of the RS are obliged to take all measures and actions within their jurisdiction to ensure the implementation of this law, and all those acting in accordance with it in the RS are exempted from criminal liability.
The amendment to the Criminal Code of the RS introduces a new criminal offense – disrespecting or failing to implement decisions of institutions or bodies of the RS.
"An official or responsible person in an institution of the RS or a local self-government unit or any body of a local self-government unit, as well as an official or responsible person from the RS who performs duties in BiH institutions, who does not apply, implement, enforce, or otherwise respect a decision of an institution or body of the RS, or who prevents, or otherwise obstructs the application, implementation, or enforcement of such a decision, shall be punished with imprisonment from six months to five years," the law states.
The Law on the HJPC of the RS stipulates the establishment of this institution at the entity level. It is stipulated that the HJPC of the RS will be financed from the entity budget and donor funds and will have 13 members.
As for the Law on a Special Register and Public Transparency of Non-Profit Organizations, or the so-called foreign agents law, it prohibits them from engaging in political activities and any political activities, and penalties are prescribed up to 5,000 KM for certain violations, up to the prohibition of operation if they act contrary to the provisions of this law."
