Novalić couldn't have dreamed it, but Nikšić gets away with everything: The Law on Construction Land is the same as Fadil's, but there's no reaction!

Although there were nine items on the agenda of the FBiH Parliament, the FBiH Government decided to postpone the session again. The reason given by the FBiH Government was disagreement regarding fiscal laws. However, this has opened up a justified suspicion that the real reason is that the government does not have the votes to adopt the agenda and laws, as the unharmonized laws could simply have been withdrawn from the agenda, and the remaining items could have been considered.

But, we have already learned that the FBiH Government, led by Nermin Nikšić, gets away with a lot, things that former Prime Minister Fadil Novalić couldn't have imagined even in his wildest dreams.
Thus, we will remind you of a Draft Law that was determined by the FBiH Government led by Novalić, and the same law in the form of a proposal was determined by Nermin Nikšić's Government in March 2024, but the public perception is completely different.

This is about the Proposal for the Law on Construction Land in the Federation of BiH, which, as we said, was sent to the Parliament of the Federation of BiH in March. Do we need to mention that this proposal has not been considered from March until today, and there have been no reactions either?

And the FBiH Government in 2021, or rather the federal Prime Minister Fadil Novalić, had to withdraw this Law on Construction Land from the session of the House of Representatives of the FBiH Parliament, which caused justified sharp reactions because the law transfers forest land from the state and registers it as the property of the municipality or city in whose territory it is located.

Then, after the Constitutional Court of BiH declared the Law on Forests of the RS unconstitutional and stated that forests are state property, the proposed law in the FBiH came as a cold shower.

We remind you that the Constitutional Court of BiH clearly stated in 2013, and subsequently multiple times, that only BiH has the right to regulate state property.

And today's current proposal still contains that controversial provision, which no one has paid attention to so far.

The controversial provision is found in Article 4 of the proposed law, which stipulates that 'construction land that is registered in the land registry as social, state property, public property, or state-owned land without the registered right of use by another person, if it has not become the property of another person by force of law, after the entry into force of this law shall be registered as the property of the municipality, as part of the city of Sarajevo or the city in whose territory it is located, in accordance with the provisions of the Law on Real Rights, unless otherwise regulated by a special law'.



This controversial Article 4, Paragraph 2, best shows the tendency to register ownership of state property. Then, and now. However, Nikšić can do what Novalić couldn't, it's just increasingly evident that he doesn't have the necessary majority, so everything has stalled. Just like the public outcry.

One of the most vocal deputies in the House of Representatives of the FBiH Parliament in 2001 who was against this law was Irfan Čengić, the current mayor of the Sarajevo Municipality of Stari Grad.

He even went to a meeting with SDA leader Bakir Izetbegović at the time, but has not commented now, nor has the rest of the SDP MPs from the FBiH Parliament.

And despite the peace they have, the Trojka (Trio) still lacks the strength, and it seems the ability, to ensure the functionality and stability of the government.
